The High Court has ordered that a complaint under Indian Penal Code Section 302 (murder) has to be filed against the police officers involved in the fake shoot out on the outskirts of Ahmedabad city. The SIT that submitted it final report in the case said that Ishrat along with Javed Sheikh alias Pranesh Pillai, Amjad Ali Rana and Zeeshan Johar were killed prior to the date of encounter on June 15, 2004. However, Crime Branch then claimed that Ishrat along with others were killed in a shootout. The Crime Branch had claimed that the four were members of terror group Lashkar-e-Toiba and were on a mission to kill Gujarat Chief Minister Narendra Modi. Gujarat government spokesperson Jai Narayan Vyas said, "What are being discussed in media are some pointers that emerged during the debate on this case and certain observations by the High Court. As a state government we believe that court judgments are not meant for commenting upon and we fully respect the process of law and whatever is and shall be the judgment of the Court." In 2010, an independent judicial inquiry by a magistrate Justice SP Tamang too had concluded that the crime branch was at fault. He had even said that weapons had been planted on the victims. Those accused in the case include then Joint Commissioner of Police (Crime Branch) PP Pande, suspended Deputy Inspector General DG Vanzara, then Assistant Commissioner of Police GL Singhal and Assistant Commissioner of Police NK Amin - all IPS officers. Vanzara and Amin are also accused in the Soharabuddin Sheikh fake encounter case and murder of Sheikh's wife Kausar Bi and are presently behind bars. Modi's problem is from the link between DG Vanzara and Amit Shah, both are already charged in the Sohrabuddin Sheikh fake encoutner case. His opponents are now stating that the same team was behind Ishrat's killing as well. A division bench of justices Jayant Patel and Abhilasha Kumari on October 7, had directed the SIT to submit the final report that would conclude if the encounter of the four persons, claimed by Gujarat Police to be terrorists, was genuine or fake. Reacting to the verdict, Javed Sheikh alias Pranesh Pillai's father Gopinath Pillai said, "We knew it since beginning that it was a fake encounter. They were kept in custody for four days and tortured. There were torture and injury marks on the body of Javed Sheikh." NCP legislator Jitendra Awhad demanded Gujarat Chief Minister Narendra Modi's arrest. "This is justice given. We will directly ask for the resignation of Narendra Modi," said Awhad. The probe in the case was supervised directly by the High Court which constituted the SIT in 2010 to investigate the genuineness of the encounter after petitions were filed by Ishrat's mother Shamima Kausar and Gopinath Pillai raising questions about the police version of the incident. Ishrat case timeline: June 15, 2004: Gujarat Police claimed that they had killed Ishrat Jahan and three others killed on the outskirts of Ahmedabad. The police claimed the four were members of the Pakistan-based Lashkar-e-Toiba on a mission to kill Gujarat Chief Minister Narendra Modi. September 2009: Ahmedabad metropolitan magistrate SP Tamang calls the encounter fake. August 2010: Gujarat HC asks Supreme Court-appointed SIT headed by former CBI director RK Raghavan (investigating the Gujarat riots) to take up the case. September 2010: The HC constitutes a new SIT after Raghavan-headed SIT expressed its inability to undertake the probe. November 2010: The Supreme Court rejects the Gujarat government's plea challenging the HC order to form the new SIT. December 2010: Three-member SIT begins investigation in the case and starts recording statements of the witnesses, police officials involved. January 28, 2011: SIT member Satish Varma files affidavit stating that the encounter was a fake one. He also accuses other two members of not allowing the probe to be done in an unbiased manner. April 8, 2011: Gujarat HC division bench warns the state authorities that the court will hand over the probe to central agencies like CBI or NIA if the state does not allow SIT to probe without hindrance. rEKEUM6YdmU

CBI to investigate Ishrat Jahan case Ahmedabad: The Gujarat High Court on Thursday directed the Central Bureau Of Investigation (CBI) to investigate the Ishrat Jahan alleged fake encounter case. SIT Chairman RR Verma has been directed to file a fresh FIR within a span of two weeks and handover the entire report to the CBI. At present, the Special Investigation Team (SIT), the CBI and the National investigation Agency (NIA) are investigating the case. The victim's family favours an SIT probe. An FIR may also be filed in the case. The CBI was also directed to form a team of officials to investigate the case that will be headed by an officer of the rank of DIG. The court also said that NIA cannot be entrusted with the investigation because it is beyond the charter of NIA and this case cannot be termed as terrorist act after the SIT report. IH Sayed, advocate for Ishrat's mother said, "Happy with the CBI. The judgement is amazing and have got what we initially wanted. Court has told SIT to file a fresh FIR and also transfer the earlier FIR as well. Court has also told CBI to inform the court incase their was interference from any side." The encounter may have been fake but the terrorists were real.The parents of the girl are using the encounter to prove that the girl was innocent where as it has been mentioned by the investigating agencies that there was enough evidence to prove that the girl was a part of the terrorist group.The headlines should be.... Terrorist killed in fake encounter. In a country where poor children die of starvation and lack of basic medical facilities...I shed no tears for the likes of these.We do not have crores to feed biryani to each one of them like we are doing in Kasab's case.Good riddance! Same goes for Kisenji case.People who don't give their victims a chance don't deserve one either.

Arrest Gujarat ADGP in Ishrat case, orders CBI court I think this is big news. Second highest level police officer in state getting arrested seems unheard of. But it is only just the way those 4-5 people were killed in cold blood. In another blow to the Gujarat police, already in the dock for a series of fake encounter killings, a special CBI sessions court on Thursday ordered the CBI Additional Chief Judicial Magistrate to issue an arrest warrant against Additional Director- General of Police (CID Crime) P.P. Pandey in the Ishrat Jahan case. The Additional Chief Judicial Magistrate had turned down a plea by the CBI to issue a warrant against the official. The CBI challenged this in the sessions court. Pandey, an accused in the case of murder of Ishrat Jahan and four others, was summoned by the CBI twice earlier, but he failed to appear. Three senior police officers — G.L. Singhal, N.K. Amin and Tarun Barot — besides four other policemen, have been arrested in the case. Ishrat Jahan, a college girl from a Mumbai suburb Mumbra, was killed along with her friend, Pranesh Pillai alias Javed Sheikh, and Zeeshan Johar and Amjad Ali Rana, on June 15, 2004. The Gujarat police then claimed that the group had links with the Lashkar-e-Taiba and was out to assassinate Chief Minister Narendra Modi. But, it was Metropolitan Magistrate S.P. Tamang, who first termed these killings fake encounter in his report. Later, the girl’s mother moved the court seeking a CBI probe. The Gujarat High Court constituted a three-member SIT to probe the killings. The team, in its report, said the killings were committed in cold blood when the four were in police custody. The case was then handed over to the CBI.
