The funda is this : rape is defined roughly as sex with a woman (recently amended to include men) without their consent. Now, under the contracts law, consent obtained under false pretense or false representation is not valid consent. So the law holds that consent to have sex ontained on basis of promise of marriage is not valid consent if the man declines marriage subsequently. Hence the sex amounts to rape. Now, the same contracts law says that an offer or an acceptance or a statement given under duress is not legally binding.
