The December 16 Delhi rape case has brought about some changes, but not all are positive. The Punjab police have found at least 10 rape cases, of the 63 lodged in December, to be false. This, however, came to light when, following the Delhi case, stern guidelines were issued to ensure prompt response in gender-related offences. "Revenge was the main motive in these cases," Jasminder Singh, ADGP said in Chandigarh on Wednesday. In Haryana's Kaithal, the SP office received a complaint on Monday by eight girls accusing the management of the private college of 'sexual harassment'. Tough to read brother? Anyways, there should be a law where such accusations if proved completely falsified should bring penalty to those making charges. (And i mean completely and clearly false ones, otherwise it will deter woman from reporting even more.)

It happens more because system is lackadasical and it takes ages to decide cases. Every law is misused everyday, either by police or citizens. Don't get why single this out ?
Laws created for specific set of people are much more likely to be misused than generic laws. It will serve no purpose if people keep turning blind eye to misuse of laws. It is in fact a big problem. The way dowry harassment law has been abused should give lawmakers some idea about putting enough deterrent against false cases. May be equal punishment in case of charges being proved conclusively false and proved to be brought with intentions of revenge, extortion or to cause damage to reputation etc. I can't see why anybody should oppose provisions against false cases, in any law. Misuse of Dowry Harrassment law has been accepted by all and sundry. One recent tweet from a feminist like Sagarika Ghose Have seen how dowry law is often terribly misused and prevents genuine cases from being heard. An emotionally created law open to misuse

It is much similar to statutaory rape in US. There was a case where daughter out of anger towards her father said he raped her. There is another case in today's ToI. After being in relationship with a married man for few months, female realises that she was being raped. In current media wave and public atmoshphere, there is sudden spurt of such cases which are in fact veiled extortion attempts. These arrests are ridiculous to say the least. With such cases, it would be extremely stupid of a guy in india to think about Live-In relationships. AHMEDABAD: A woman Lieutenant Colonel of Indian Army now posted in north India has accused a city-based police inspector of rape. The accused PI, F M Qureshi who is posted as the security in-charge at the Gujarat high court, has been arrested by the crime branch at his Gandhinagar residence. On Monday night, the woman Army officer met the city police commissioner, S K Saikia, and accused Qureshi of raping her multiple times in various cities of the country. Saikia intimated senior officials of the crime branch and directed the agency to take her complaint. Mahila police station officials under supervision of crime branch authorities registered her complaint and simultaneously arrested Qureshi. Assistant commissioner of police, crime branch, K M Patel said, "The Lieutenant Colonel has been sent for medical examination to the Civil Hospital." In her complaint, the woman has said that in October when she was posted in Bhuj, a junior officer had committed suicide. Family members of the suicide victim had later filed a complaint of abetment to suicide against the woman Army officer at the Bhuj police station. She had then moved the Gujarat high court and filed a quashing petition against the police complaint. Here, she met Qureshi who helped her out in the legal issue . She was so impressed by Qureshi's conduct that she had written a letter of appreciation to the city police commissioner. The two continued to meet. The couple stayed in hotels in Ahmedabad and also went touring to several hill stations including Dehradun, Nainital, Kulu and Manali. The woman claims that Qureshi had promised to marry her and only then she had accepted his advances. All these meetings took place in over a month - between November 1 and December 6. The woman claims that Qureshi went back on his word. It is then that she filed the complaint against Qureshi for getting physically intimate with her by making false promises. Extortion claim On December 11, 2012, Qureshi had filed an application of complaint at the Sola police station in which he had claimed that the woman Lt Col is threatening him and his wife over telephone and is trying to blackmail him. Qureshi claimed that she was demanding Rs 25 lakh. He had also included call detail records of the mobile phones used by the woman to make those calls. Qureshi also wrote letters of intimation to Gujarat high court and city police commissioner in this matter. Complainant's flip-flop On December 11, the woman had written a letter to the city police commissioner to complain against Qureshi. However, on December 29, she wrote another letter to the commissioner, seeking to withdraw her complaint. Cases against Qureshi In 2005, when Qureshi was posted in the Anti-Terrorist Squad he was accused in a complaint of loot at the Dabhoda police station in Gandhinagar district. This matter is still under investigation. Another complaint was registered against Qureshi for allegedly asking for a bribe from a builder's son caught in illegal possession of a country-made pistol. Qureshi was charged with extortion in a complaint filed in this regard at the CID (crime). The issue is now in court. Hotels under scanner The woman has mentioned two hotels - Ashish and Neelkanth - where she had stayed with Qureshi. The cops have traced Ashish hotel and sought for CCTV footage to establish the woman's claims. "However, the hotel owners have said that the CCTV footage is no more available since the hard disk where all the video recordings were stored is corrupt now." There are several hotels which have Neelkanth in the names. "Since the complainant is unable to pinpoint the exact location of this hotel, we propose to take her to every hotel with this name to zero in on the right one," said crime branch officials.

A female above 18 should not be allowed to withdraw consent after sexual intercourse. She can very much do so while it's happening but not afterwards. If the SC wants to prosecute men who sleep with women promising marriage but back out later, it should ask the police to register a case of cheating. Terming it rape doesnt make a lot of sense.

The Supreme Court has stated in the past that a consent under a false promise of marriage is no consent. People have been convicted under this interpretation of the law. This is a grey area of rape laws in India and IMHO needs to be looked into again.

How Silly. Dont the Indian men have a right to change their mind after committing in a relationship ? And how is it proved that the Man had promised marriage to the Woman ? Did the Man write some " Letter of Promise " on a stamp paper and handed it to the woman before the bonking took place ? Cases such as these are unfair to the genuine victims of rape .

This is a grey area of rape laws in India and IMHO needs to be looked into again.
Though it does happen every now and then, the number of such cases is extremely small when compared to the number of actual sexual violence against women on a regular basis and the number of rapists who escape without punishment because of hesitation on part of the victim's family to pursue the case Just that these few cases serve a useful purpose for rape apologists to create a bogeyman to downplay the horror of rape.

And how is it proved that the Man had promised marriage to the Woman ? Did the Man write some " Letter of Promise " on a stamp paper and handed it to the woman before the bonking took place ?
Mainly testimony of close friends of both the boy and the girl, SMS texts, circumstantial evidence etc. A few have been aquitted as well. Another grey area in rape laws is statutory rape when the age difference between the boy and the girl is not significant. Like an 18 year old boy having consensual sex with a 17 year old girl makes the boy liable for the offence of rape. This provision was introduced to prevent child abuse/grooming, but in cases like I mentioned above, has the potential to deliver grave miscarriage of justice.

"As far as the incidents of rape are concerned, people try to sort them out at panchayat level and only when there is no satisfactory outcome, the victims approach the police. The rape victims should straightway come to the police," the SP said, adding that by the time such cases are registered with the police, medical examination of the victim becomes difficult resulting in poor conviction rate in rape cases. "An awareness programme is on the cards," he said. A senior lawyer, Gopal Prasad, has a similar take on it. "Most of the complaint cases of sexual assault filed in a court turn out to put pressure on their adversaries." Lodging rape complaint cases is a convenient way of settling scores, he said. "The rape cases are generally used as tool to settle land disputes," Sishir Kumar Das, another senior lawyer, said. "People are generally poor and illiterate. They are little bothered about the stigma of rape charges. Any pretext is good enough to file a rape case against their rivals and adversaries," a social activist and lawyer Shaji Verghese said.
There are reports all over that false cases are major impediments in prosecution of rape cases. These false cases ensure that conviction rates remain poor to very poor. I am not blaming only females for this. In rural area this is family decision to settle scores with other group through false rape allegation. It is one thing to give statements based on ideology, while to deal with problem on ground is completely different thing.

I am not sure about how much evidence can be collected through texts and friends to nail anyone . But , shouldnt everyone have a choice to backout even after the promise has been made ? This shouldnt even be a crime IMO . All it implies is that an adult doesnt have the right to change his mind .

Absolutely. Kishanganj = India. And I trust a policeman to give accurate crime numbers from his constituency which reflects on his own administration's record. In fact it is the policemen who broker settlements in most of these rape cases by scaring victims and warning the families of the damage to their izzat should they choose to proceed in court That number alone would dwarf the cases where women sleep with men consensually and later accuse them of rape. But go ahead, Keep googling for random reports and assure yourself that evil women prowl on the road looking for innocent men to dupe and falsely accuse of rape.

And yes, Kishanganj is not India, I just gave you a sample. I have seen such reports from police and judicial systems of multiple districts across states.

Where is the evidence? A random assertion is not evidence, he just spouted a number in a small district which you are trying to extrapolate to the entire country. Techie held on rape charge TIMES NEWS NETWORK Pune: The Sahakarnagar police on Sunday arrested a 30-year-old techie for allegedly raping his college mate promising that he would marry her. The police said the complainant was raped between August 2010 June 2012 at his residence in Balajinagar and various lodges in the city and Bangalore. The suspect, Manohar Pocham Dharani (30), of Chandrapur district was produced before the court on Monday and remanded to police custody till January 17. Sub-inspector of the Sahakarnagar police station N P Rupvate told TOI that the suspect and the victim met while pursuing their masters in computer application (MCA) at a Chinchwad-based private college in 2010. The suspect promised the victim to marry her. "He used to call her in his rented room in Balajinagar and also call her to various lodges and rape her," Rupvate said. The suspect raped her even in Bangalore, where the complainant had got a job. In June 2012, the suspect declined to marry the victim. After waiting for him for over six months, the victim lodged a complaint against him. "We have arrested him. We are investigating further," Rupvate said.

It is important to understand that there exists : [A] Genuine Rape Cases and False Rape Cases. Both exist in the society and both are evils. The challenge is to recognize which is [A] and which is . Categorizing either into the other bucket is ethically and morally wrong. However, you can't categorize either at prima facie by reading news paper articles. You need to delve deeper into the case and understand the context taking into account various factors - only then one would be able to categorize a rape allegation as True or False. Each case is unique and needs to be looked at individually keeping aside emotion and nostalgia. @ Post#19, I find it hard to believe how having intercourse while promising to marry and later on not marrying could be classified as rape.
