Devyani Khobragade, deputy consul general at the Indian consulate in New York, was arrested on charges that she allegedly presented fraudulent documents to the United States State Department in support of a visa application for an Indian national employed as a babysitter and housekeeper at her home in Manhattan. The arrest of Khobragade, who is currently employed as the Deputy Consul General for Political, Economic, Commercial and Women’s Affairs at the Consulate General of India in New York, was announced Thursday by Preet Bharara, the United States Attorney for the Southern District of New York. “Foreign nationals brought to the US to serve as domestic workers are entitled to the same protections against exploitation as those afforded to US citizens. The false statements and fraud alleged to have occurred here were designed to circumvent those protections so that a visa would issue for a domestic worker who was promised far less than a fair wage. This type of fraud on the United States and exploitation of an individual will not be tolerated,†Bhahara said. The 39-year-old Indian official was charged with one count of visa fraud and one count of making false statements, which carry maximum sentences of ten years and five years in prison, respectively. Khobragade is expected to appear on Thursday afternoon before US Magistrate Judge Debra Freeman.

The Visa Application stated that the Indian worker employed by Khobragade was to be paid USD 4,500 per month. According to an employment contract, Khobragade would pay the domestic help the prevailing or minimum wage, whichever is greater, resulting in an hourly salary of USD 9.75. However, the domestic help worked for Khobragade as a household employee from approximately November 2012 through approximately June 2013. The domestic help worked far more than 40 hours per week and was paid less than USD 9.75 per hour.

The US has thrown all protocol and niceties to the wind by arresting a senior Indian diplomat and handcuffing her on the street (!) while she was dropping off her daughter to school. An unbelievable snub.
and we talk about diplomatic immunity.:haha:

Does she have diplomatic immunity? Regardless, the arrest should have not have been made in public.

Does she have diplomatic immunity? Regardless' date= the arrest should have not have been made in public.
Absolute yes, unless India waives the immunity. This is not even a crime where India should consider waiving the immunity. If she had committed a murder or something serious like that, then it would be a different case. The US is totally out of line by arresting her like this without even hearing her out. This being said, there have been cases where US judges have refused to recognize diplomatic immunity. However, these were cases of grievous crimes like manslaughter etc.
