NEW DELHI: The five accused in the Badaun gang-rape and murder case may soon walk out of jail after latest forensic tests don't find any evidence of their presence at the crime scene and also cast doubt whether the two sisters were raped. The CBI says the alleged rape of the two teenaged cousins is 'doubtful' and "parents seem to have concocted the allegations, either themselves or under somebody's influence". The incident had sparked a nationwide outrage as the two girls were found hanging from a tree after being gangraped as claimed by parents. The reports virtually give a clean chit to the five accused- brothers Pappu Yadav, Awadesh Yadav and Urvesh Yadav and constables Chhatrapal and Sarvesh Yadav. The agency is almost sure that the accused did not have a hand in the alleged gang-rape and killing of the two girls who were found hanging from a tree on May 27, sparking a nationwide outrage. The CBI received the report of Centre for DNA Fingerprinting and Diagnostics (CDFD), Hyderabad, on Monday. The report has been shared with a panel of doctors and a final decision would be taken in a couple of days. The reports give credence to the agency's investigations, contrary to the claims of parents. TOI had first reported about the CBI not giving a clean chit to the victims' parents following their contradictory statements on the sequence of events. CBI sources on Tuesday said the agency may drop the idea of exhuming the bodies as the CDFD report has given them enough forensic evidence which could help the agency crack the case. They also said that the report confirms contradictions in the theory of rape. The five accused will be allowed to get bail as there is no clear evidence against them. As per law, an accused can get bail if the investigation agency fails to file a chargesheet within 90 days, which ends on August 28 in this case. The initial findings of CBI were in sync with the observations of UP DGP A L Banerjee who had claimed that the rape of one of the victims was not confirmed and property could be one of the motives behind the crime. He had said that a lot of evidence could have been collected immediately after the crime, but the local police had made no effort to do so. The case is heavily dependent on the scientific and forensic evidence after an independent medical board could not get the bodies exhumed as the site where the two minor girls were buried was flooded. The panel had then asked the agency to provide the belongings of the victims so that some samples could be taken for medical and forensic analysis. The accused had earlier cleared the lie-detection tests, putting the needle of suspicion on the family. This suspicion grew strong as family members and an eyewitness had failed the test. Sources said the agency is now looking at the role of a local politician who allegedly influenced the victims' family to put the blame of the killing on the five arrested accused, who belong to a particular caste.
