can she get bail?
She has legal remedies available with her in form of appeal to High Court and then to Supreme Court. So logically a person can't be asked to go through the punishment unless he/she exhausted all legal options or decides not to use available legal options. In this case, she would go to HC against this order. HC would admit appeal. She would ask for suspension of conviction pendency of appeal that would be grated and she would be given bail. In whole process she might have to be in jail for a month or may be more. If sentence was for 3 years or less she could have applied for bail in session level court itself. But in this case sentence is for 4 years so she'll have to go to High Court only.

These sort of convictions are a sham of the Indian judicial system. Laloo Prasad Yadav is walking free and conducting business as usual in his party despite a conviction. JJ will obtain a stay on the conviction and continue to walk free. First have a trial that lasts 20 - 30 years and then the convicted don't even need to serve any sentence.

There wouldn't be any stay on the conviction. It will be only suspension of conviction in form of bail.

The Royapettah police booked cases under IPC sections 147 (punishment for rioting), 148 (rioting, armed with deadly weapon) 324 (voluntarily causing hurt by dangerous weapons or means) 336 (act endangering life or personal safety of others) 506 (ii) (criminal intimidation) based on a complaint filed by two AIADMK cadres, Ilangovan and Ganesan, who came under attack. The AIADMK cadres were chased away by the DMK workers, who were armed with clubs. Police deployed for security pacified the agitators.
This is stupidity and desperation.

Seems like you cannot have a suspended sentence unless you have completed 2 years into it. I think the only legal alternative now is for a stay by high court on this conviction.
She is moving Bangalore high court tomorrow for bail which is nothing but an appeal to suspend the sentence until she has legal remedies available. Sentence becomes final only when either convict has accepted so or convict has exhausted all legal remedies. Stay on conviction is only a theoretical possibility which will not happen. Other option she has is filing an appeal against conviction which is more viable option. High court would definitely accept her appeal against conviction but benefit of that is limited until HC overturns the conviction and if it does so. Issue with that is pendency of appeal she would remain a convict and ban on her being an MLA would not be vacated.
