It is a difficult read.

 

Looks like the CBI was in a hurry to shut the case. None of the questions answered by the CBI. 

Sanjay Roy may very well be guilty but he was aided by far too many people. Unless the investigation is thoroughly completed, the Judge can't possibly award a death penalty.

 

There is no closure for the parents whatsoever.

 

West Bengal is terribly governed . Essentially they live off the Central aid with the state government and its various arms behaving life Mafia. A doctor is not safe in a hospital and the top cops and hospital administration are involved in the cover up.

In other words, that is hardly a deterrence.

 

What is a *proven* deterrence is higher conviction rates. If the perpetrator knows that it is a matter of *when* not *if* of being brought to justice.

India has an average conviction rate (stated) of 55%. This is obviously only of the cases where the police file an FIR. They just refuse to for a whole category of people and crimes. Not talking about non cognizable offenses but serious crimes. Japan has an average conviction rate of 98%. Criminals in Japan know that they will get caught. That is why they have next to no crime.

 

In India, Mizoram paid a lot of heed on proper policing and have a conviction rate of around 96%. Assam has a conviction rate of 5%. Guess where you have more crime on a day to day basis?

 

If we increase our police force, train them in forensics and investigative methods, it would be a huge deterrent. What we have now is a largely corrupt force that has no interest in solving crime, just want to be regulators of crime as long as they get their cut.

 

 

Good points. We need drastic police reforms and increase in their budget and resources . Police is just a puppet of the State govt and is only interested in maintaining the Order and not on upholding the Law. I would add that Judicial reforms are equally important. Indian Judiciary has negligible accountability, atleast the politicians have to face elections and change. 

 

However I would take those Studies claiming Death Penalty has no deterence with a bucket of salt. As such studies are usually done by 'human rights' groups which are already against Capital punishment.

West Bengal has been the political murder capital of India since decades. It will put even 90s Bihar to shame. Politicians change there but the goons don't.
