Police complaint filed against Yuvraj

Recommended Posts

NEW DELHI, Dec 13: A police complaint has been filed against cricketer Yuvraj Singh for allegedly assaulting a woman and her son, at his birthday party in Gurgaon. The police, however, had reportedly not filed any first information report (FIR) in the case till Wednesday afternoon. The incident allegedly took place during Yuvraj's birthday party in which Yuvraj Mahajan was also invited. His mother, Neelam Mahajan Singh alleged in her complaint at the DLF Police Station that her son was beaten up badly by Yuvraj and his associates. In her complaint, Neelam Mahajan has alleged that Yuvraj, his mother Shabnam and girlfriend Kim Sharma had assaulted and threatened her. "When I went to rescue my son, Yuvraj's mother, his brother and nine others assaulted me", she said. She said even after several hours, the local police had not registered a FIR report against the cricketer. According to her, she had called up the police emergency number (100) in Delhi and informed them of the incident. The Delhi Police alerted their Haryana counterparts, she said. "My son's medical examination was carried out in the night after I agreed to it. But, no medical examination of the others has been carried out", alleged Neelam Mahajan. However, Yuvraj Singh's mother Shabnam Singh told a private TV channel that Neelam Mahajan's charges were false. "She was the one who abused me a lot. We didn't say a word or do anything," Shabnam Singh said. SSP Hanif Quereshi said medical tests were being conducted on the complainant to ascertain the nature and extent of the injuries. An FIR could be lodged against the cricketer thereupon, he said. Quereshi said Yuvraj also sustained some injuries in the incident. Yuvraj Singh is recuperating after a knee injury and missed being part of the Indian team for the South Africa series.

Re: Police complaint filed against Yuvraj

tht guy mus have died in the scuffle' date=' then Yuvraj would have been Siddhu's cell mate....[/quote'] yes, if he beat the guy and he had died, it would be manslaughter. standard for everyone, cricketer or not.

Re: Police complaint filed against Yuvraj

If yuvraj had indeed killed the man and proved that it happened during self defence then yuvraj would just walk.
Alternatively, he could also plead insanity. :hic: Seriously, yes, self defence will let you off, but you have to prove it beyond a resonable doubt, if charged. Gator, there is also a category called negligent homicide which is also unintentional killing, but one where the person should have known that their actions were negligent and could cause serious harm to the other person. Basically, as long your response is proportional, you should be ok. If you respond to a slap with a whole bunch of wacks and the guy dies, you will be in serious trouble.

Re: Police complaint filed against Yuvraj Actually, yuvraj would have been booked under Section 304A of the Indian Penal Code. If yuvraj was drunk then it would come under rash and negligent act, causing death. His only relief in that case would have been section 88A ie if the act was done under good will, agreed by both party and not with an intention leading to death.

Re: Police complaint filed against Yuvraj we have pretty weird law Section 96 of the Code declares that nothing is an offence, which is done in the exercise of the right of private defence. But Section 99 says that the right to private defence in no case extends to the inflicting of more harm than it is necessary to inflict for the purpose of defence, i.e. the principle of proportionality. So if yuraj felt threatend then he along with his friends should have tied up the guy and handed him over to police rather than killing him.
