Whats wrong with that ? Saying 'if you do something that is a distinct evidence of mental illness, you will be put in a mental ward" seems like a very good message to send to society - certainly more ethical than ' SHADDAP AND DIE".

Why ? What makes it best ? Why is the Saudi Arabian system of fear-based social policing superior to the remedy-based social policing of nations like Norway ?!? Especially since they are both batting around the same crime levels, so what purpose is fear serving, that makes it required ?

except we see time and time again that :

a) fear-based rules do jack $hit unless the enforcement of the law is near 100%.  If you think you have a chance of 'beating the system', then the fear component is useless. Which is why fear-based policing gives result in only a minority of cases ( few middle eastern countries and tiny nations like Singapore where laws can be implemented with near 100% rate). 
 

b) even if the enforcement of the law is 100%, fear-based dis-incentive is no more successful than simple remedial based dis-incentives. There is no crime that is significantly less prevalent in Saudi Arabia than Norway or Japan. 

Whereas one can say that the remedy-based justice system IS empirically superior - at the very least, it gives a small % of rehabilitated people. Fear-based death-cult like systems do not have that.

 

 

The one thing that people need to understand, is retribution has ZERO place in justice. Killing a rapist does not undo the rape. Whether you argue for execution, castration, life in jail or mental help, the objective, in all of them- is prevention and/or remedy. Ie, the argument for executing a rapist is not 'badlaa' or vengeance, it is prevention - so that person doesn't go rape another. 
 

 

The moment you see the function of the justice system as protection and not vengeance, remedy-based system immediately jumps out as a superior system than fear-based system
