In Shiney's favour, well Women have a crazy ace up their sleeve to get back at people... call consensual sex as **** and can use it as a tool to get leverage, money, fame, whatever it may be. Speaking for the woman, she is a domestic help and maybe doesn't need either of it. Regardless of whose right, Shiney hasn't thrown a promising career away by taking a wrong turn. His acting in Hazaaro...., Gangster, Metro will be remembered for atleast the next few years. I'd met him at Malhar a few years back. Seemed to be a decent fellow. But well, everyone makes mistakes.

Nothing consensual at all. While the reliability of these tests in doubtful in some instances, this ( from the look of it) is not such an instance. While I don't know all the details about the case, what seems very clear is that Shiney thought he would get away with it and didn't even bother changing the bedsheets and other paraphernalia to hide (or minimize) traces of his crime. When the police went to his home more than 2 days after the crime, every thing was as the maid described it to be. His lawyer in defense said that since he didn't try changing the bedsheets it indicates that nothing happened. huh. The forensic results obviously put a big dent in his defense. To me it seems like he committed the crime thinking he's someone big and could get away with it. I won't swear, but may he rot in hell for spoiling a young girl's life for a few minutes ( or probably in his case, seconds :P ) of 'sport'. @ MTC: You are right. This could be a landmark ruling, because the victim retracted her statement and said that she had 'framed' Shiney in cahoots with the woman who got her hired at Shiney's place. But that could be under duress or some kind of pressure and the court still went ahead on the basis of the evidence. This ruling could act as a deterrent. And unless the forensic evidence has been manipulated or tampered with ( which is possible but highly improbable), I think the ruling is just. Not taking sides here, just that the whole conspiracy against Shiney theory seems very far fetched and improbable and has no legs to stand on. Don't judge him by just that one public appearance. He probably would put his best face forward in such a situation. Even Hitler, Genghis Khan and Mariyam can appear to be good people after a small 2 min tete a tete. Wouldn't put violence beyond him, especially when he found out that his celebrity status alone wouldn't get him out of the mess. I'm not into criminal law and my understanding of these things are not upto date, but there is a forensic report in such cases is considered highly accurate. The victim, after the initial accusations, has categorically said that she was not raped. I read some of the reports on TOI and none give any account of physical injuries. The whole case stands on the basis of a torn hymen, blood traces and bldily fluids on sheets, curtains and pillows. Now, that proves the intercourse, but not the lack of consent. I think the reports are missing something.

According to TIO reports, the woman got a marriage proposal and wanted to distance herself from the case.

So since you seem to be a lawyer in the making, how does the law differentiate between ra.pe and consent? Do they do a lie-detector test or simply take the words of the woman on face value? Coz I guess they simply take it on face-value and put 2 and 2 together. I read about a case a few years back, similar case. The guy was thrown in prison for 12 years and then the woman's lie came to the notice of the police. She destroyed a man and his family's life. What Shiney did was quite ridiculous. But there is a massive difference between ra.pe and consensual sex. The stigma attached with ra.pe can haunt a man equally all his life. Agreed, he screwed up. But where is the evidence that the woman is not trying to get back to him or something? And I agree with you. Malhar and Mood I are simply awesome. Those days of undergrad college.
