PM Manmohan Singh, in a meeting with President Asif Ali Zardari, here also said he would only travel to Pakistan if there was a "substantive" outcome. India would be willing to allow a Pakistan judicial commission to cross-examine 26/11 witnesses, after the home ministry has taken approval from the judiciary. Prime Minister Manmohan Singh assured Pakistan President Asif Zardari that India would move on this after Zardari said there were problems in Pakistan to taking the 26/11 trial forward. Are Indian citizens or policemen legally obliged to depose before a pakistani commission? Can some legal mind throw some light on this? Notwithstanding the legality of this process, this is a horrible idea. It is clear as daylight that pakistan intends to nothing to bring the 26/11 to justice, and they will only use this opportunity to create some drama and run down whatever investigations the Indian authorities have done.
seedhi Posted August 31, 2012 Author Posted August 31, 2012 Let me add that it disgusts me to even contemplate the cross examination of the policemen who fought the terrorists, the survivors, eyewitnesses and the investigating teams by a bunch of terrorist sympathizing/supporting pakistanis on Indian soil.

No. India didn't allow Pakistan to do so earlier and even now home ministry will have to take approval from judiciary. So, it won't entirely be govt's decision. Notwithstanding the legality of this process, this is a horrible idea. Outside of a court, only commissions of inquiry set up by the government have the power to cross-examine witnesses. There is already a mountain of evidence to convict those who were responsible, and there is no reason for India to allow itself to be blackmailed on this issue.
