Very brave of complan to do so and they must be very confident of the move. They know that Horlick will try to come after them and I think that's exactly what they want. That will give them the stage to demonstrate and show that they are better than Horlicks. However, remember that MRTPC reserves the right to stop an ad even if it does not break any law if MRTPC believes that it might lead to unhealthy practices. This reminds me of the Pepsi-Coke fight in the US in the early 80s. Pepsi opened several public booths to invite the general public to come and taste both pepsi and coke and decide which one is better. They would serve both pepsi and coke to the person in different glasses without labels- the person does not know which one is pepsi and which one is coke. Then he has to taste and say which one he liked better.....without knowing what is what. This strategy was masterminded by Pepsi's then Marketing VC John Sculley. Then something very funny happened. Scully visited one of the big such booths and the reporters there forced him to take the test himself. Scully drank from two glasses and pointed to one that he liked. It turned out to be coke. :hysterical: Coke then had a print ad with the tag line: "Coca-Cola- John Sculley's favorite drink".:hysterical: John Sculley then went on to become pepsi's president briefly before joining Apple as CEO. Then came the infamous episode where Scully used some very unethical ways to try to eject Steve Jobs out of Apple and take control of the company. Apple was one of the most promising companies at that time. He even became successful in his attempts to an extent and kept Jobs out of Apple for quite some time till the staff revolted and refused to accept Scully. Scully finally gave in and left Apple.

Couldn't Sculley sue/stop Coke from using his name in their ad?

Coke didnt really over do it. There was one print campaign released with that tag line which was viewed by the ad industry as a humorous take on Scully and Scully's best shot was to keep it that way. A court case would have given huge publicity to the fact that Scully actually liked coke over pepsi. That would have looked like a campaign for coke financed by pepsi. And that would have ended Pepsi's campaign saying that Pepsi was better than Coke. If your own marketing head likes coke, how can he tell people to buy pepsi?
