While Dutt has already moved the Apex Court asking for a few more weeks before he begins his jail term, an advocate representing him had approached the designated TADA court with an oral request for permission to surrender to jail because of “law and order complications”. The court, however, took a tough stand on the request, remind the advocate that there is no provision for the accused to surrender directly to jail. The judge dismissed the plea saying that when an accused surrenders, a large number of set legal procedures need to be followed such as verification and identification, which the accused cannot avoid in any way. Special public prosecutor, Deepak Salvi, said, “The submissions were made orally and no written application was filed. The court however, has not allowed such request.” Dutt has to surrender by Thursday, April 18, before the TADA court in keeping with the directive of the Supreme Court, which recently upheld his conviction under the Arms Act, when it passed its verdict on the ’93 blasts case. The SC had, however, reduced his term from six to five years. The actor has already served 18 months in jail and has to spend three years and six months more to complete the sentence.
someone Posted April 16, 2013 Posted April 16, 2013 That's bad from Dutt. During his only statement about the verdict, he said he will surrender within the allocated time of SC. And now, this person wants more time. That's pathetic, 4 weeks itself should have been enough.

I am not sure if it was the legal thing to do but yes it would have been really bad for others involved. He seeked 6 months and got 4 weeks. BTW he should get in ASAP so he can get out at the earliest and be done with it. Im sure he can pull some strings and use his good behavior etc to get out within 2-3 years

The only problem with this decision that he is the only person whose request for an extension has been accepted.

Where can be access such a list? I think the reason that there is hug investment on him and many would lose their money is a good enough excuse to give him a month's time more. His sentence has not been reduced, just deferred.

Altaf Ali, Essa Memon and Yusuf Nalwala got the extension of time to surrender. The SC dismissed Yusuf Khan's extention plea saying that he can get treatment in prison. A bench headed by CJI will hear the Zaibunissa Kazi plea at 2pm. Bollywood actor Sanjay Dutt got a month's reprieve on Wednewsday, while 11 others convicted in the 1993 Mumbai blasts and released on bail surrendered before a Mumbai court after the Supreme Court rejected their appeals. Mumbai TADA Special Judge GA Sanap directed the 11 to be shifted to the Arthur Road Central Jail, from where they will be transferred to other jails in the state later. Among those who surrendered Wednesday were Sadashiv Talwadekar, a customs official who was sentenced to eight years in jail and has already spent six years. He was charged with taking bribes to permit the landing of an arms consignment at Shekhadi beach, Raigad district, allegedly sent by the absconding prime accused, Tiger Memon, from Pakistan, a few weeks before the March 12, 1993 serial blasts in Mumbai. The convicts included four policemen -- RD Mali, PM Mahadik, A Maneshwar and SY Pashilkar -- who have been sentenced to six years in jail and underwent around four years in prison before being granted bail. Sachin=GOD Posted April 21, 2013 Posted April 21, 2013 Sanjay Dutt files review petition in SC against conviction MUMBAI: Actor Sanjay Dutt, who recently won a month's extension to surrender, has now moved the Supreme Court (SC) by way of a review petition against its March 21 judgement upholding his conviction under the Arms Act and sentencing him to five years in jail. A Delhi-based legal team prepared and filed the petition on Friday. It may be heard next week before the same bench. The SC had not interfered with the TADA court's guilty verdict against Dutt for possession of arms before the March 12, 1993, Mumbai serial blasts. He was held guilty only under the Arms Act for possessing an automatic rifle in a notified area, but was acquitted under the Terrorist and Disruptive Activities (Prevention) Act, which had also been invoked against him. The trial court had specifically said the actor was not a terrorist and accepted his confessional statement that he had kept the sophisticated AK-56 rifle for self defence because of the communal tensions in the city that year. His contention in the SC was that a confession made under Tada cannot form main evidence for offences under other Acts against an accused, when the accused is acquitted under Tada. His contention in the review petition is that the three-judge bench judgment in the Rajiv Gandhi assassination case, which held a confession under Tada would be valid even elsewhere and which the SC had relied on in the 1993 blasts case against Dutt, must be reconsidered. The petition filed to review a binding decision of the SC is based on an apparent error in a judgment sought to be reviewed. A strong case has to be made to get a review, but if the plea is dismissed, a curative petition can be filed to ensure that there is no gross miscarriage of justice. A review petition has to be filed within 30 days of the date of judgement or order. One of his lawyers said the matter would be heard next week. The SC had, while giving him a four-week extension to surrender, made it clear that it would grant no further time. Dutt has seven films on the floor in various stages of completion. The Road Ahead If a review petition is rejected, Sanjay Dutt has to surrender by May 18 unless the SC grants further time He may also file a mercy plea with the President Review petition A binding decision of the Supreme Court/High Court can be reviewed in a review petition. The parties aggrieved by any order of the Supreme Court on any apparent error can file a review petition. Such a petition needs to be filed within 30 days from the date of judgment or order. The petition should be circulated without oral arguments to the same bench of judges that delivered the judgment (or order) sought to be reviewed. Courts generally do not unsettle a decision, without a strong case. What is a curative petition The concept of curative petition was evolved in 2002 by a SC judgment to cure any defects that may lead to gross miscarriage of justice in a final judgement/order of the Supreme Court, after dismissal of a review petition. The petitioner has to aver specifically that the grounds mentioned had been taken in the review petition filed earlier and that it was dismissed by circulation. This has to be certified by a senior advocate. The curative petition is then circulated to the three senior-most judges, and judges who delivered the judgment, if available. There have been reports on how he even submitted a false application full of incorrect information when he asked for a 6 months extension to finish pending work.
