Should not be a problem at the source, where it can be an internet based SMS gateway, (however even there, an SMS gateway to PSTN interface as to be uniquely identified by some number) Anyway, in context of this noble-cause company (SMSONE), the "mobile journalists" might sooner or later be needing to send more than 100 sms per day.

This is like saying that people are constantly harrassed by vendors and hawkers who knock on doors during the day trying to sell items, hence no one is allowed to visit anyone else, more than 5 times a week. I understand that you want to advertise your passion for unrestricted freedom of speech, but this thread has got nothing to do with it. Its a regulatory move by the telecom authority which restricts the number of messages (not the content) to avoid spamming by businesses. The opposing position would be to criticize the sweeping move by the regulatory authority which does not distinguish between spamming and legitimate personal usage. Limiting the number of messages is not an attack of freedom of speech, nor are the people who are supporting it advocating any such measures.

way2sms is not working. All bulk sms packages which are send sms's through net are also not working. Some companies operations have been severely impacted because of this. For example, Radio Cab services. These companies send sms's to their customers and drivers through bulk message packages. All of them are struggling because of this. Crap Idea..

IMO the idea behind the move by Trai is right - i.e. to limit the spam messages which is a serious issue with 10-20 messages per day. My older number used to get anything between 40-50 messages a day. However , its execution is very wrong. You cannot apply such a blanket limit in order to restict only the spammers since it ends up hurting everyone - both personal users and legitimate businesses like travel, cabs, schools which use SMS as an information broadcasting mechanism. Even the government uses SMS a lot - few days back I saw a rural healthcare application which sends SMS reminders to mothers to get their chidren vaccinated before the due date. The TRAI move has serious implications for such initiatives and a better thought out plan should have been put into place.

Of course it is. Its an attempt to restrict advertising. Besides, if there was a 100 page limit for every novel would you call that an attack on free speech? ps: I don't like the phrase 'free speech' simply because no such thing exists. There is only violence (or threats of violence) for speech.

Spamming is very different from legitimate advertising, which the government is not seeking to regulate. The underlying idea behind the limit is to control the unsolicited messages being thrust upon users right from stock tips to insurance to internet what not, which is quite intrusive. Messages which sometimes fill up your inbox and make it impossible for personal messages to reach you. The analogy of the novel is incorrect here, since authors dont typically make 50 copies of the novel and post it to your home which you incidentally read start to end thinking that it is something that is of concern to you. The TRAI order applying to everyone is both wrong and inconvenient to the general public, but bringing a free speech angle is going tangential to what is being discussed here, especially since there is no restriction on the content of what is being conveyed in the message

Putting 100 message limit to stop spamming is like saying no more than 5 murders are allowed for serial killers. with this non-sense 100 SMS limit, many sincere business will get affected (e.g. check out the history of www.smsone.in). Spammers will find their way out, sooner than later.
