Sistema and Telenor have filed petitions invoking clauses of India's Bilateral Investment Treaty with Russia and Singapore respectively. They are blaming the Govt for not protecting their investment in India.

They are blaming the Govt for not protecting their investment in India. That doesn't exonerate the companies. They did wrong and they're simply trying to put up a brave face. Getting 3 countries involved in a private bribery matter gone horribly awry is extremely childish and disrespectful to, one, us as people and two, to our judiciary.

Companies like Shyam Telecom (which has a Joint Venture with Russia's Sistema and operates under "MTS" brand) did no wrong. Same with Tata Teleservices. These companies followed the existing Telecom Ministry rules - now 3 years later if the Supreme Court says that the rules themselves were faulty then how can these companies be called "wrong" for following the existing rules?? Sure, some companies like Swan or DB Reality etc took advantage and they should be punished but IMO those companies which were genuine shouldn't be punished so severely for faulty rules and regulations set by the Telecom Ministry (and Telecom minister). As to invoking provisions of the India-Russia or India-Singapore trade treaty to protest their investment - its nothing unusual and happens many times in many cases all over the world but its just that this is a pretty big and high profile case so these fact are coming into the media. Apart from this, the Russian Govt has a direct stake of about 20% in Sistema Shyam so the Govt itself is a direct participant so Sistema has every right to invoke provisions of India-Russian Investment Treaty. IIRC even Vodafone is talking about invoking provisions of some trade treaty because after the Supreme Court had ruled that they were not liable to pay taxes, the Govt simply changed the rules to retrospective effect so as to force them to pay the tax - I think in cases like this its justified to bring in other countries.
