BCCI told the Supreme Court that it knew Modi, who contested for the president’s post, had received maximum votes and that he would emerge a clear winner. “We know the result he (Modi) is a clear winner. He has 26 out of 33 votes,†BCCI’s counsel told a bench of Justices AR Dave and JS Khehar. The submission was made as soon as the hearing began so as to prevent the bench from opening the envelopes containing the results of the poll and declare the result officially even before the BCCI’s objections to Modi’s candidature was legally examined. The BCCI counsel contended that declaration of the result should await adjudication of their objections that Modi, who has been slapped with a life ban for financial irregularities in the IPL, could not have been allowed to contest at all. BCCI’s counsel C A Sundaram and senior advocate Haren Raval, appearing for Modi’s rival for the post of President in RCA R P Sharma submitted that Modi was wrongfully allowed to contest and declaration of result by the court will have far-reaching repercussions. It was also argued that since Modi was already banned by BCCI from holding any position, his taking over as RCA chief would debar the state cricket association from participating in the game and will also restrict players affiliated to it from being part of the Indian cricket team, in which there are two players from Rajasthan. Modi’s counsel Harish Salve however opposed the contention, pointing out Srinivasan was at the helm of affairs in the BCCI despite his son-in-law facing criminal case in connection with the IPL spot fixing. Realising that the entire controversy over the RCA polls was turning out to be a battle between Srinivasan and Modi, the bench decided to adjourn the hearing for March 4. The bench had on the last occasion said it would declare the result of the RCA so as to decide the future course of hearing in the matter. The court had underlined that objections by the BCCI and others against accepting nomination of Modi despite a life ban would require to be heard only if he is elected. Pursuant to the decision by its working committee, BCCI has intervened in a matter already pending before the court wherein the Rajasthan Sports Act 2005 has been challenged. Former RCA secretary Kishore Rungta had filed this petition, challenging the provision that abolished voting rights for individual members. BCCI’s petition claimed that any sort of association of Modi with the RCA’s affairs will badly affect the image of the cricket Board. It added that Modi’s nomination was not right since RCA had imprudently rejected Board’s objections to the former IPL commissioner’s candidature. The Rajasthan elections were conducted under the court order. The court had appointed Justice NM Kasliwal, former judge Supreme Court, and Justice SP Pathak, former judge Rajasthan High Court, as observers for ensuring free and fair election in the RCA. Both observers had rejected all objections and allowed Modi to contest for the president’s post of the RCA. The BCCI has been firmly opposing Modi’s return to Indian cricket administration, with lawyers claiming that Rajasthan faces expulsion from the Board if Modi becomes RCA president.

If Lalit Modi holds post, RCA will be suspended: BCCI NEW DELHI: The cricket board (BCCI) on Monday told the Supreme Court that Lalit Modi, facing a life ban for allegedly swindling $80 million from the IPL, has won the election for Rajasthan Cricket Association (RCA) president but stalled declaration of the result saying it would force the board to suspend RCA that would lead to dropping of Rajasthan players from Indian teams. The SC had appointed Justice NM Kasliwal to supervise the RCA election and send the result in a sealed cover to it. BCCI wants the court to first decide the contentious point whether Modi was eligible to contest elections to RCA before declaring the result. A bench of Justices AR Dave and JS Khehar said there was a simple solution to problem made to appear complicated by the high decibel arguments by the board and its supporters. "Let us open the RCA election results. If Modi has lost, then there will be no need for the sound and fury from the board and its supporters. But if he has won, then we will hear all parties," it said. Rising above the din created by counsels who spoke simultaneously and attempted to outdo each other by raising their voice, senior advocate CA Sundaram said, "We know the ground reality. Modi has won by a margin of 26 to 6 votes." But he, along with senior advocates Harin Raval and Rajiv Dutta, said it would be ill-timed to officially declare the results as the board was firm that Modi was not eligible to contest the elections as he faced a life ban. When the bench said that it will "just declare the results and the board is free to take further action", Sundaram said if Modi is officially declared the president of RCA, the board would be forced to suspend RCA's affiliation to BCCI and no player from its jurisdictional area could be part of Indian teams. "If RCA gets disqualified because of Modi getting elected as president, then players coming from that region cannot be part of the board's cricket teams. Players from Rajasthan will have to be dropped immediately," Sundaram said. The bench deferred declaring the election results sent to it by Justice Kasliwal till March 4. The court's decision to defer hearing and opening of election results was followed by bitter trading of charges between Modi and BCCI. Senior advocate Harish Salve, appearing for Modi, said, "It is basically a big ego problem. N Srinivasan (board president) has a big ego issue against Modi. It is about clash of personalities. He cannot take it that a man whom he engineered to expel from the board has now rubbed his nose on the ground in the RCA elections." Sundaram retorted, "A man who swindled $80 million from IPL has rubbed the nose of BCCI president on the ground? Modi is not even eligible to contest elections." Salve returned fire, "The BCCI president's son-in-law is found involved in a betting scandal for an IPL team owned by the president and still he is still eligible to head the cricket body." Trading of charges and BCCI's insistence not to declare the results led the bench to say, "We feel that cricket administrators' post should be open to election only to those who have played at least Ranji Trophy. Cricket has been ruined by politics." The board is contesting Justice Kasliwal's decision to validate Modi's nomination despite objections by his rival candidate Rampal Sharma, who is believed to be close to incumbent president CP Joshi. I got to say if he comes out on top, I may not like Srini but you have to admire his power and the people like Sunder Raman who are vital cogs in his operation. I personally think Srini needs to back off on the Modi front. Lalit modi is known to be close to Vasundara Raje. But he does not get along with Jailey a close modi confidante. Narendra Modi himself is the Gujarat cricket chief. Dont think he has relinquished that. You dont want to be playing with forces way beyond your kin. Srini has had his time at the top and now its time to exit gracefully.

Yup thought the same he is like warlord a tyrannical one don't know how he sleeps at night with all the hate. I read in his sons interview he gulps couple of pegs of whiskey may be this his sleep medicine.

One part of me admires Srinivasan. From what i read he has taken his father's cement business from being a small time operation (relatively) to one of india's biggest cement companies. I would have cracked under the pressure of this media campaign a long time ago. There are things to like about Srini. I read he has been sponsoring talented Indian cricketers via India Cements since the 1970s. That is something to admire. Cause during those times Indian cricket was bust. There was no money to be made. It was a charity. No doubt he has not been a good BCCI prez.
