amiret Posted March 31, 2015 Posted March 31, 2015 “a confession made by a person before a police officer not below the rank of Superintendent of Police…shall be admissible in the trial of such accused, co-accused, abettor or conspirator.” Even under duress ? Section 25 of the Bill states, “No suit, prosecution or other legal proceeding shall lie against the State government or any officer or authority of the State government for anything which is in good faith done or intended to be done in pursuance of this Act.” Good move . After all , Kauser Bi was kept in illegal custody , murdered and her body was burnt by Gujarat ATS officers in "Good Faith " . :haha:
gslv Posted March 31, 2015 Posted March 31, 2015 That confession before police clause need to be removed if not recorded by camera. Even though I agree that we need stringent laws ,innocent ppl should not be made target. This is the land of Sri Ram who gave priority to justice.
Texan Posted March 31, 2015 Posted March 31, 2015 http://www.thehindu.com/news/national/other-states/gujarat-passes-controversial-antiterror-bill/article7053036.ece Good move. Need to implement this all the states, esp Maharastra, NE, WB, Kerela and even TN. Maharashtra already has MCOCA. Along with TADA in the past, it has helped control organized crime in the state.
Malcolm Merlyn Posted March 31, 2015 Posted March 31, 2015 Huge potential for misuse. Yes and No.Maharashrra has MCOCA its similar.Hasnt been misused.
Malcolm Merlyn Posted March 31, 2015 Posted March 31, 2015 Btw the ultimate authority lies with the court to decide whether a statement is admissible or not.
