'Infosys victimised me' DH News Service, New Delhi: Alleging victimisation by Infosys on the grounds of being a member of the minority community, a former network engineer with the Bangalore-based IT major said that he had been removed illegally without any valid reason. Rashid Hussain, a senior network engineer working with the Jaipur BPO of the company, told reporters here on Monday that his service was terminated by Infosys in the wake of the Jaipur blasts as he was “illegally†detained for nine days by the Special Operations Group of the Rajasthan police. When asked for reaction, an Infosys statement mailed to Deccan Herald said, “After the event in Jaipur, we ran a background check on Rashid Hussain. It revealed serious discrepancies which led to severance of our relationship with him. This is normal action taken. We have no other comments to offer.†Rashid explained that he had not furnished any false statement like inflating his work experience. Since he was working with a college and a firm simultaneously, he gave only two years as his teaching experience in place of three and one year as his working experience with the firm he was then working for. “It is clear that Infosys did not want to keep me any more with them not because of what they are calling misstatement on my part, but clearly because I was detained by the police after the blasts,†Rashid said, adding that he had already moved the labour court in Jaipur against the Infosys. Rashid also plans to approach the National Commission for Minorities for redressal of his grievance. “The question Infosys needs to respond is how is it that after three years of working with them, did they suddenly find out that I had given wrong information which warranted a punishment of the magnitude of removal from service?†he asked.

Though the police released him after nine days of detention, Rashid was sacked by his employer. The software engineer now wants his job back and is fighting the system that he says is “surgically targeting educated Muslims”. Although the police did not find anything substantial against him, two weeks after the release, Rashid was told to face an internal panel at Jaipur office of Infosys on June 23. The organisation maintained that he had furnished false work experience during the interview. “They did not mention the detention at all. This clearly shows they just wanted to get rid of me because of my religion,” said Rashid. “I want to ask the Infosys authorities how they suddenly discovered that my documents were not in place. Had I not been picked up by the police, would they have fired me?” Despite repeated attempts, spokesperson for Infosys Technologies could not be contacted. Rashid was part of the Students’ Islamic Movement of India (SIMI) before the organisation was banned. “This association with SIMI was the reason I was detained. I left SIMI because I had ideological differences with the organisation. This incident has led to character assassination of my entire family,” he said. Backed by human rights activists like Shabnam Hashmi, Rashid is in the city to talk to mediapersons about what he calls “re-victimisation” — first by police and then by society. “My career has been ruined because of the reckless manner in which the police behaved. I had been working with Infosys for three years and they never had a complaint against me. Despite being released, Infosys fired me without giving me any reason,” he added.

I think he has been wronged ! Everybody fudge their resume. 3 years of service warrants that he has backed his resume.

punjabi_khota Posted August 20, 2008 Posted August 20, 2008 Don't they have usually a clause in the contract that anytime any discrepancies are found in the information given to the company, the employee can be fired. Hell, the admissions dean at MIT was fired after 20+ years of service, since it was discovered he/she didn't have the degrees as claimed in the CV. So even if it has been 3 years of service, if there was ANY lie on the CV, he is a goner. Infy hires a bajillion employees every year, and they probably don't do a very rigorous background check at the time of hiring. "Everyone lies on their CV" isn't gonna cut it.

So, infy may be right on micro technicalities, but obviously this is blatant discrimination given the timing etc. This is not correct what they did - atleast thats how it appears so far.

I think you did not get my logic. It appears he lied on the resume, and did not get caught earlier. Now, unfortunately for him, he came under the scanner from the company again because he was picked up by the police, and his lies were caught by the company. If that is the case, I don't think he stands a chance in court. Unfortunate ? Maybe. Blatant discrimination ? No.

He was also told that an engineering firm in Patna where he had worked earlier was not in existence. Hussain said he had explained to the panel that since his teaching job had required him to spend only five hours a day at the academic institution, he had mentioned two years instead of three and that the firm had shut down. Hussain has challenged the decision by Infosys in a labour court in Jaipur. He mentioned 2 instead of 3, bcos he worked part time. Nothing really wrong! And, the firm ceased operations, so that happens in business too!

So you have no problems in hiring say a ex-KKK or Hamas member ? a reformed ex member of the KKK or Hamas, yeah sure, i would hire him. As i would do for a reformed ex convict who has served his/her time and paid their debt to society. life is about improving yourself and being better than you were yesterday. if indeed rashid is a sincere employee, then there is no reason why he should not be reinstated. heck, the whole process of running a background check was initiated after his illegal detention (illegal because he was not charged with a crime and not granted due process, violating his fundamental constitutional rights)... does infosys run background checks on all its employees?

What is legal detention would you mind enlightening us.. you suspect someone you detain them for questioning more so when you are dealing with crime of terrorist blast proportion.... very fact that he was let go tells me there was no malice.. I know these days it;s fashion to shout about everything would you midn telling us how else is police supposed to question any suspect..

(Racial is the wrong word anyways, it should have been communal). If there was a discrimination on basis of race/community, he would not have been hired in he first place....to be fired after three years. It has become a farcical trend for minority members to scream "discrimination" for everything. As if they have a right to special treatment because they are minority. Those med students were fired for bad performance and they sued AIIMS for discrimination....what the hell!! Second, we do not know what kind of discrepancies were found in his background check. No, its not alright if you show two years instead of three years because you were working part time. You have to mention that you worked "part time" for three years. You never know what he had been doing for that one missing year. That firm that closed down.....there would be records that the firm did operate in the past. If its a limited company, there would be records at the registrar. We do not know for sure that it was the mistake of the company. We do not know for sure that it was the mistake of the employee. That's what courts are for- to see evidences and make a decision.

I know these days it;s fashion to shout about everything would you midn telling us how else is police supposed to question any suspect.. there is nothing such as legal detention. if you are indeed taken into police custody, the constitution determines your rights and it states that unless you are charged with a crime and arrested on a warrant, you may not be detained by the police for a period of more than 24 hours. furthermore, if you are arrested, you are required to be made aware of the charges against you, and be provided access to legal opinion at the earliest. he was detained without a warrant and for an abnormally long period... thus the illegal detention.

If this guiy wasn't smart enough to understand this bit,he probably isn't smart enough to work in their organisation. I don't blame his organisation.

I don't blame his organisation. harsh! he did renounce the organization after he endured their ideology first hand, and he deserves credit for that. i was a member of a couple of religious organizations on my campus, such as the hindu student council and one another that i shall not name; but i renounced my membership when i discovered what a farce they were. now i was told by a few others that the HSC is quite a mismanaged outfit, but i still signed up in a fervor to participate with something i then identified with... but thereafter i changed my opinion of them. now i dont expect to be held accountable for their latest botched job...
