No, in fact most of them would get away. If the guards or other witnesses have seen individuals hitting the victim, they will be punished. Otherwise the court could never be sure who attacked and who didnt. The reason is since there were a number of people, there could be and practically must be some people who didn't want to get violent. Law says that you must not punish an innocent even if 100 guilty get away. Therefore, since the court can not determine which individuals from that crowd did not participate in that assault, they will have to let the entire lot go.

CEO lynching a warning for management: Govt Press Trust of India Tuesday, September 23, 2008, (New Delhi) The government on Tuesday termed "simmering discontent among the workers" as the main reason behind the death of Graziano's CEO L K Chaudhury in Greater Noida. "This should serve as a warning for the managements. It is my appeal to the managements that the workers should be dealt with compassion," Union Labour Minister Oscar Fernendes told reporters at a press conference in New Delhi. He said, "There are disparities in the wages of permanent employees and contract workers. The workers should not be pushed so hard that they resort to whatever that had happened in Noida. "It is a fact that the number of organised workers has been decreasing. It came down from seven per cent to six per cent. We are going to discuss the matter of hire and fire policy in the next Labour Congress. First we deal with PSU and later with private sector on the issue." The workforce is "unable to express its simmering discontent over the management policies", leading to strained ties between them and the management, he said while expressing his condolences to members of the bereaved family. The minister is expected to visit the incident site on Wednesday. About two months back, workers of the company were dismissed. The story on TOI was quite interesting today. The workers were dismissed, followed by a court case and a high court had instructed the dismissed employees not to enter the company premises. The workers forced inside, started rioting and when the CEO came out to ease the tension, he was beaten to death. I hope they send each of them to jail for murder. The labor minister's statement from Beetle's post is inexcusable. How idiot and mean can people be?

New Delhi: The Noida police have arrested 136 people in connection with the attack on the Chief Executive Officer of a multinational in the National Capital Region on Monday. While 13 of those arrested have been booked for murder, 63 have been charged with rioting. Lalit Chaudhary, the CEO of Italian company Graziano, was allegedly bludgeoned to death by agitating workers who were dismissed a month ago. A day after the shocking incident, questions are being raised about security in an area that’s becoming the country's crime zone. Could the police have saved the Chaudhary’s life? Reports suggest just two policemen arrived, an hour after they were called by the plant employees. Just six armed policemen were posted at the factory when the trouble started and reports have it the private securitymen at the plant had locked themselves inside. There was no police officer to give orders in case of trouble and the agitating workers were not stopped despite a court injunction that they should not be allowed within 300 metres of the plant Choudhary was allegedly attacked and beaten to death by a furious mob of workers who were fired two months ago and were protesting against their dismissal. While police maintain the company was working at a solution when the situation went out of control, employees have other complaints. “I called the police but they came after 45 minutes. Even when inspector came, there were only five constables,†says an employee. SSP Noida RK Chaturvedi told CNN-IBN the SHO has been suspended. “Definitely the response was not fast enough we have suspended the concerned SHO. This was a sudden incident. It was a regular compromise meeting which went bad because of the contents of the apology letter. Over 125 people have been arrested. We have charged 63 people with rioting and murder. It was a sudden incident, neither they nor us was expecting trouble. We have provided security to all other firms also and to this one in earlier days,†he said. The management of Oerlinkon Graziano has issued a statement on Choudhry's death, terming it a criminal action. The statement says the police reached the spot only after the trouble-makers fled. Oerlikon Graziano's CEO Marcello Lamberto, in an official statement released by the company from Italy, said, "This is by no means a regular labour conflict but is truly criminal action. Oerlikon Group is close to the family of Mr Chaudhary in this terrible moment and it should be noted that we obtained court order that the striking employees should stay beyond 300 m away from the factory." Meanwhile, Confederation of Indian Industries has condemned LK Chaudhary's killing. Chairman of northern region, CII Salil Singhal said, “It is tragic, unwanted and gory act of violence and we strongly condemn the actions which led to Mr L K Chaudhary's death.
