Crookbond Posted July 5, 2012 Posted July 5, 2012 Generally' date=' that wouldn't suffice for the court to order an injunction or a temporary restraining order. Because the onus lies with the naive customer in that case. It has to be shown that the parent company (Samsung in this case) is deliberately plotting to get customers confused and is tricking them to buy their products instead of Apple products which look similar.[/quote'] In fact, it has been the basis of many cases - Samsung's tablet looked very similar in form factor, OS icons and even size/shape (FFS Samsung really?) to an iPad. Of course, there were some patent infringement which strengthened their case. The aforementioned was more a premise behind which the patent war crusade has been carried.
The Outsider Posted July 5, 2012 Posted July 5, 2012 Oh, knock off it. The freaking GUI that you so much love on your MacBook was copied off Xerox. Jobs almost went broke trying to copy the GUI's he was shown at Xerox, so much so, that he was booted off his team and forced to join some other team instead. Apple complaining about patent violations is as laughable as the Saudi's complaining about human right abuses. Who stole your goat?
Rajiv Posted July 5, 2012 Posted July 5, 2012 Consumer is not stupid, tablet users know the difference between an Android device and an apple product. Apple has the market covered, people don't say "tablet or "cellphone" anymore, its ipad and iphone. Android crowd is completely different and are not new users, they are apple >> switched over to the droid and this is what apple is concerned about so they will pull up these law suits but can you really stop consumer choice? As a consumer, let them fight it over and if one needs to get their phone/tablet, they will buy it from elsewhere, there is always a way. Frankly, they should work on their product drawbacks..the most popular iphone is still working on 3G where LTE is already running for 1-2 years, once they adopt it, it will be considered a new technology coz it was released on apple ( case in point: siri ) Anrdoid is your PC of cellphone where one can configure a lot, iphone is your typical mac but either way, iPad is still the best tablet out there ( if it only had flash )
EnterTheVoid Posted July 5, 2012 Posted July 5, 2012 Who stole your goat? You complaining about Apple's patent violations; Pot, meet Kettle.
DomainK Posted July 5, 2012 Author Posted July 5, 2012 Apple was the first major company to open an App store for day to day developers. As for other companies copying Apple it happens blatantly and Apple is completely right to sue the sh!t out of these idiots who can't design their own products. Yes, they can sue, but that makes them hypocrites as well because of their earlier opinion that a tech company, for the greater good of society and technological advancement, should not be too possessive of their products and inventions. I am not accusing Apple of the lawsuits, I am accusing them of conveniently changing their philosophy when their turn came.
Crookbond Posted July 5, 2012 Posted July 5, 2012 I don't know why people keep bringing up the Flash argument. Adobe itself has said it wouldn't support flash for mobile devices.

This may be true but they are the same as every other company out there including Samsung and Microsoft.
The Outsider Posted July 5, 2012 Posted July 5, 2012 You complaining about Apple's patent violations; Pot, meet Kettle. Where did I complain about Apple's "patent violations"?
panesarv Posted July 5, 2012 Posted July 5, 2012 We should only buy Apple products and only they should exist in market :) Happy, outsider?
The Outsider Posted July 5, 2012 Posted July 5, 2012 Yes, they can sue, but that makes them hypocrites as well because of their earlier opinion that a tech company, for the greater good of society and technological advancement, should not be too possessive of their products and inventions. I am not accusing Apple of the lawsuits, I am accusing them of conveniently changing their philosophy when their turn came. What turn came? They were the first major company to allow and streamline app development - they have done whatever was needed for your everyday user to develop apps for the community. Major companies copying their design is a completely different thing.
EnterTheVoid Posted July 5, 2012 Posted July 5, 2012 Where did I complain about Apple's "patent violations"? Oh please, stop being pedantic when you know the intended meaning. Apple suing others for copyright violation is hypocrisy of the highest order since they themselves stole the GUI idea of Xerox. Maybe Apple should get the sh!t sued out of them since they couldn't design their own products.
Rajiv Posted July 5, 2012 Posted July 5, 2012 I don't know why people keep bringing up the Flash argument. Adobe itself has said it wouldn't support flash for mobile devices. Well, as a cricket lover - I don't see Apple's view point when an android phone lets me play the match whereas the iPhone shows me a star and I run around for workarounds which hardly work, same for some of my soccer loving friends. That was in the past anyways, it won't be supported ( officially ) in Android 4.1 too so we have to wait for the websites to change over to HTML 5 ( I guess )

I agree that Apple's dominance is indisputable and that they have left everyone behind when it comes to innovations and user experience, but I don't think iPhone has become synonymous with mobile/cell phone or that iPad has become synonymous with tablets, like Google became synonymous with search. iPhone is still not a general public's phone, it's for those who can afford it. Brand synonymity with usage comes only when a very large majority of the target market uses no other product. As good as Apple is, it is not a common man's product, it's not something an average human being can not do without. Nokia came very close in the Indian market, still most Indians blindly buy Nokia, but still it could not come even close to synonymity.
The Outsider Posted July 5, 2012 Posted July 5, 2012 We should only buy Apple products and only they should exist in market :) Happy, outsider? If you do that piece of sh!t companies like Samsung and Microsoft won't be able to survive - think about the number of people you will be making unemployed if you stop buying their crappy products. Do something for the improvement of the society - buy sh!t from Samsung and Microsoft. Imagine the number of choolhas Vista lit up!
panesarv Posted July 5, 2012 Posted July 5, 2012 I'm sure Apple will hire those unemployed workers :) Apple uses many samsung parts so with more apple products on the market, I'm sure those people will get re-hired. Take it easy, Outsider :)
Rajiv Posted July 5, 2012 Posted July 5, 2012 PS...why is everyone discussing this in a fan/cult like sequence. Enjoy your device, can embrace all technology ..lets see what iPhone 5 brings in store, coz then other manufacturers will try to beat it and that's the beauty of competition

Enjoy your device' date=' can embrace all technology ..lets see what iPhone 5 brings in store, coz then other manufacturers will try to beat it and that's the beauty of competition[/quote'] Exactly...Apple is falling back in terms of creativity (Jelly Beans really took it to the next level)...only thing Apple can do now is sue!

Every accessory, car stereo to headphones and the salesman talk is with the presumption that you own a iPhone

In addition, eat just eats up processing cycles and battery life. HTML5 is the future.
