StriKe Posted November 1, 2011 Posted November 1, 2011 NEW DELHI: Telecom consumers will now be able to send up to 200 SMSes per day from a SIM, as against the earlier limit of just 100 SMSes per day imposed by the Telecom Regulatory Authority of India (Trai). "The authority has received representations from some of the service providers and consumers to increase the limit of 100 SMSes per day per SIM. The authority has considered these representations and decided to increase the limit of 100 SMSes per day per SIM to 200 SMSes per day per SIM," Trai said in a statement today. To deter unsolicited SMSes by telemarketing companies, Trai had earlier restricted the number of non-commercial SMSes that can be send from a SIM to 100. There was no restriction on commercial messages sent through telemarketing companies registered with Trai. The new cap of 200 SMSes per sim per day will be effective from today. After much delay, TRAI in September this year came out with recommendations to stop pesky calls and text messages, directing that no operators will permit the transmission of more than 100 SMSes per day per SIM. In a bid to clamp down pesky SMSes, the Telecom Regulatory Authority of India (TRAI) had said that it will impose a termination charge of 5 paise per SMS on operators from whose networks commercial messages originate. Termination charges are paid by an operator from whose network calls or SMS originate to the one on whose network these communications end. These charges impact tariffs. "The promotional SMS charge shall be Re 0.05 (five paisa only). The Originating Access provider may collect the promotional SMS charge from the registered telemarketer," TRAI said in a notification. At present, some operators charge a termination fee of up to 15 paise per SMS. I used to send ~ 50, and even that I thought was a lot. The wonderful thing about messages is that they have a time stamp. I have taken great efforts to save many of the nice ( read: best of luck, congratulatory, whiny, romantic) messages that I received over the years. While any sane person would just discard all the junk, I downloaded nokia pc suite, and various other such software to transfer these messages. After a few years, when I have my first marital discord/arguement/fight; I'll show my husband those messages, and say " see, you used to send me so many nice messages and that too multiple times in a day. You have changed, not me " :P +++++++++++++++++++++++++++++++++++++++++++++++++++++++ People here are confusing commercial messages with those form private sims. When you get a msg from TM-ICICI - it means that ICICI bank is advertizing through Tata Mumbai. It is via the internet. And this is telemarketing company registered with TRAI and hence have no such 100 or 200 msgs ki limit. So, in short TRAI is ensuring that all sms based marketeers register with them. :acute:

"We are, therefore, of the opinion that the impugned provision (of Telecom Regulatory Authority of India (Trai) insofar as it covers non-UCCs (Unrestricted Unsolicited Commercial Communications) SMS in the present form as it exists, infringes the freedom of speech of the citizens. "And the conditions imposed upon the freedom of speech is not reasonable which would be protected under Article 19 (2) (which deals with reasonable restrictions of freedom of speech) of the Constitution," a bench of Acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw said. The bench, however, made a distinction for unsolicited commercial calls and said that the restriction imposed by the Trai on them was valid. "We have already pointed out that the Trai has found that UCC calls and SMSes were interfering with the personal lives of the individuals as often telemarketers would call them up for selling their products. All such calls sere unsolicited, since the receiving party does not want to receive such calls or messages. "These UCC messages disturb the recipients, intrude into their privacy, and impose a cost in terms of the time and efforts. In fact, they infringe the equally importance rights of the unwilling recipients," it said. Partly allowing the petition of Anil Kumar, secretary of NGO Telecom Watchdog, the court, however, granted liberty to Trai "to come out with more appropriate regulations for regulating unsolicited non-UCCs SMSes that could meet the test of reasonableness under the Constitution."
