jalebi_bhai Posted June 9, 2013 Posted June 9, 2013 Here is the situation: My roommate got fired from Goldline International, a retail seller of gold and silver coins, and precious metals for investors and collectors, on Wednesday. The reason he was fired is because Goldline claim that he lied on his legal application. The thing he lied about was the question asking him if he knows any relative of his who has worked in another precious metals firm. It so happens that his brother co-started 2 small-scale companies in Atlanta that dealt with precious metals. My roommate claims that he didn't now anything about as his relationship with his brother is not great. His brother is currently a co-founder of Investment Diamond Exchange, a firm that is a retail seller of diamonds and is pretty up and coming. My roommate is planning on suing Goldline for wrongful termination. He believes that Goldline fired him because they think he is leaking contact information to his brother's company. Key point 1: I'm not sure if the question on his application was 'Do you have' or 'Do you know' a relative.....he tells me it is the latter..... Key point 2: My roommate is going to use his conversation with a client his brother recommended to him for Goldline as evidence against Goldline's claim against him.... So, does he have a case?

It's quite clear that he put down the wrong answer giving goldline every right to terminate your roommate. Extremely sad...but that's just how the law works. Then again, I am no lawyer. just commonsense Goldline is obviously worried about leakage of important information to a competing company. It sucks b/c even if you don't like a family member, their actions will somehow shape your future.

If so, thats his only hope i think. If you are a previously bonded person with zero criminal record, then the onus is on the 2nd party (his employers) to prove that he lied in his application and 'credible doubt' doesnt apply. If he is not bonded previously, it will be extremely hard for him to win the case. PS: To desis here, if you can score a job while being in college/university or just in-between work being a security guard, this is the perk for it- it gets you the 'bonded' status.

Nope......he didn't even have car insurance till last week where he called a friend's company on the spot after meeting with an accident.... I think the key evidence here will be his job application.....he is trying to get his brother's company to get in touch with Goldline.....I really don't like his odds.....he says his colleagues are willing to convince management to reconsider their decision.....but I think he has already burnt his bridges....
jalebi_bhai Posted June 9, 2013 Author Posted June 9, 2013 Ok.....he just got off the phone and told me that Goldline has a 5 year injunction against them and that if he can get in touch with the compliance manager......he might've a solid case.......thing is.....I really can't take what he says at face value......
Jersey #10 Posted June 10, 2013 Posted June 10, 2013 I totally feel for your room mate. The job market is down and dirty in the US these days! A job isn't guaranteed even if you work for a Forbes 500 company! There are no guarantees!
