Because of Gujarat govt she didn't severest punishment. Her crimes were so blatant that it was beyond gujrat govt to save her.

Punishment for a single killing is death as per IPC 302 and here for somebody convicted of murders of 100s people say so what she spend 7 years in jail. Just brings numbness. Yes. Be it session court, high court or supreme court, case would always remain kodnani vs state of Gujarat. And if state of Gujarat doesn't oppose she would get favourable judgement from any of these courts. Educate yourself a bit about processes before arguing on passion and fanboy-ism.

She is a progeny murder of more than 100 people including 35 children. How her crimes are less than that of any terrorist who kill 100s of people.

And the bail was granted by the High Court. Naroda Patia massacre: Maya Kodnani granted bail by Gujarat high court AHMEDABAD: Gujarat high court, on Wednesday, granted bail to Maya Kodnani, former minister and "kingpin" of the 2002 Naroda Patia massacre case in which 97 people were killed, on grounds of her sickness and possible delay in trial. While ordering her release, a bench of Justice V M Sahai and Justice R P Dholaria suspended her 28-year-long sentence imposed by the special SIT court in August 2012. Kodnani is the first of 32 convicts to come out on bail pending appeal before the HC. While convicting her, the trial court had observed that she was "tremendously favoured" by Gujarat police and all investigators had taken "great care" to see that she was not booked. On the roles of Kodnani and another main accused Babu Bajrangi, the court said, "The communal hatred displayed by the communally surcharged mob was on account of instigation by Kodnani and Bajrangi or on account of some vested interest who wants division of society on communal bases." In her petition, Kodanani had stated that she suffers from intestinal tuberculosis, heart ailment, spinal problem as well as severe depression. She had said that she is required to take electric shocks from time to time, and was given such treatment earlier this year, when she was released on temporary bail. Kodnani, a professional doctor and the only woman to have been held guilty in the post-Godhra riots cases, has challenged her 28-year jail term. She has demanded bail on the ground that her appeal questioning the lower court's verdict is not likely to be heard in the near future. Besides, she had questioned the lower court's evaluation of evidence. She claimed that the 11 witnesses, who nailed her, had given statements with discrepancies. She also claimed that they spoke at a belated stage and theirs were embellished versions, and the court should have scrutinized them before accepting them. While a witness had alleged that Kodnani fired from a gun and a person sustained injury, it was established that the person in question was not injured at all. It has been alleged that the court accepted testimonies of witnesses in part and rejected certain portions. Significantly, Kodnani's application for bail moved in the Gujarat High Court recently revealed why there was disquiet over the judgement. "The application is an eye-opener and indicates that the entire judgement was based on presumptions and assumptions. It is a travesty of justice," said Hasmukh Patel, a senior lawyer of the Gujarat High Court who has studied the case. Patel's strong stance is not without basis. Of the 170 witnesses in the case only 11 say that they saw Kodnani at Naroda Patiya around 9 am on February 28. And of these only two say that Maya Kodnani had taken part in the rioting. One of these two, who said she had seen Kodnani firing from a revolver, had in fact given a media interview in 2002 itself about the Naroda Patiya massacre but had not named Kodnani in it. Significantly, these 11 witnesses surfaced six and a half years after the incident thus giving grist to the charge they were tutored by anti-RSS activists. According to Natubhai Vaghela, a businessman and RSS supporter, the most questionable part is the time sequence given in the verdict which is just unbelievable. The judgement agrees with Kodnani that she was at Gujarat Vidhan Sabha's morning session in Gandhinagar on February 28 till 8.40 am. But, thereafter, it believes the witnesses' incredible story that Mayaben reached Naroda Patiya, a distance of 27 kms from Gandhinagar in just 20 minutes, instigated the Hindu mobs and came to Sola Civil Hospital scaling 24 kilometres of circuitous route through the city to see the dead bodies of the 59 Hindus and then scaled the same distance back to reach Narodagam (an area which is just 2.25 kms from Naroda Patiya where Muslims were killed too) between 10.30 and 11 am, and again instigated the Hindu crowd. So what the judgement says in effect is that Kodnani scaled a distance of 75 kilometres in 90 to 100 minutes and in between instigated Hindu mobs at two different places and also met the relatives of the 59 slain Hindus at the hospital. "Mayaben should have had feathers to fly to be able to scale that distance and do all that in less than 100 minutes," observed Patel. Interestingly, Kodnani had claimed that she started from Gandhinagar at 8.40 am for Sola Civil to meet the relatives of the 59 Hindus who were killed and left the place only at 11 am. Surprisingly, the evidence of four government personnel including an executive magistrate who said they had seen Kodnani at Sola till 11 am was overlooked in the verdict. But there are other details in the case that question the conspiracy theory. The scene in the Naroda area on March 28 morning was restricted to just stone pelting between Hindu and Muslim mobs till 10.30 am, when two Hindus were killed by Muslims in different incidents and one of them with horrid cruelty. "These two incidents sent the Hindu mobs into a reactive frenzy and led to the massacres at Naroda Patiya and Narodagam areas in close vicinity of each other," aid lawyer Mitesh Amin. In the first case, rickshaw driver Ranjit Vanjara was pulled by a Muslim mob in a lane and killed. Even his eyes were gorged out. In the second incident, a frightened Muslim truck driver drove his truck through a Hindu mob killing a Hindu. Both these incidents happened between 10.30 and 11.30 am on that morning and are on police record. The former Gujarat minister who was convicted in the Naroda Patia rioting case was released on bail from Sabarmati prison in the afternoon. Later, she got herself re-admitted in the Civil Hospital — this time not as a prisoner but as a regular patient suffering from multiple ailments. The SIT had filed a petition seeking a stay on the bail a day after the high court allowed it to go in appeal to the Supreme Court. The delayed action on the SIT's part rendered its petition infructuous and the high court turned it down. "The bail order has been executed and the convict released on bail. Therefore, the application has become infructuous," said the bench of Justice V M Sahai and Justice R P Dholaria. In 2012, special SIT court judge Jyotsna Yagnik had found Kodnani guilty along with 31 others. Kodnani was sentenced to 28 years imprisonment in 2012 by the court which had named her as the 'kingpin' of the Naroda Patia massacre of 2002 in which 97 people were killed. For the past three months, she was admitted in the Civil Hospital for treatment of serious illnesses including intestinal TB, sciatica and acute depression. On Thursday morning, she went from the hospital to the Sabarmati prison and around noon, she was formally released from the jail on regular bail. "Maya Kodnani's husband, Dr Surendra Kodnani, had come to take her from the jail," said jail superintendent RC Bhagoriya. CIvil Hospital officials said that Kodnani had told them that she would return to be re-admitted in the public hospital for treatment. "She is now in the special ward as a regular patient. On Friday, changes would be made in her admission and she would be referred for medical and psychiatric treatment as well," a top official of the Civil Hospital told TOI. Doctors attending on Kodnani said she suffers from intestinal TB for which she will be on medicine for nine months. "For her severe depression, which borders on suicidal tendencies, she had to be given shock therapy twice. However, her family did not agree to more shocks for her after she bit her tongue once. She has been put on strong anti-depressants. She also suffers from severe backache with radiating pain in the leg and she is being treated for that as well," said one of the doctors. Regarding the delay by the SIT in filing a petition for stay on the bail granted to Kodnani, legal experts are of the opinion that a prosecuting agency or any litigant usually demands a stay on an order immediately after the order is pronounced. The courts sometimes grants relief merely on oral submission by lawyers, but the SIT chose to raise this issue a day later, said the experts. On Thursday morning, SIT's special prosecutor mentioned the case before the court which asked it to come up with an application. The SIT was not even prepared with papers in the morning.
