Not ours. Lots of factors go into it - such as precedence, feeling of regret from the perp (or not), level of impact or if there is no precedence, the prevalence of crime balanced with penalty as deterrent. All these, are the judge's domain. Even in a jury trial, the jury hands out the verdict - guilty or not guilty. Its always the judge who deciedes the penalty. And to my knowledge, except in exceptional circumstances, you cannot appeal a judge's award (of penalty). You can only appeal the verdict of guilty/not guilty.
