Zap, I saw the pic of Mohammad and well .......... Religious and personal insults are two issues I hate to go near. Don't be mistaken into thinking, I've never used personal insults or had a laugh at satirical religious cartoons, but, now I make it a point to stay away from them as far as possible as they're sensitive issues and lead to fights / fistercuffs etc The reason I make such a big deal of these two issues is that you may inadvertently say the wrong thing to the wrong guy at the wrong time and regretting your actions for the rest of your life

I posted this on the Politics forum ... but cant blame India as such ... this is how our majority population wants things to be ... This forum is a very good example of how twisted we are when it comes to freedom of speech as ICF also doesnt allow to post such things. (It never stops the "founders" from indulging in chest thumping that we are a beacon of free-speech on the www .... but thats another story :-D ) As I keep saying yatha praja thatha Raja
At least this is a news remember when Franocis Gautier's show on aurangjeb got tanked no mainstream media even bothered to report. His crime: well he depicted Aurangjeb's cruelty over sikh gurus .. In India truth must not be told lest it offends some mullah( wonder why mullahs sud be offended in first place for crime of aurangjeb lest he is a hero of theirs)

what is wrong in protesting peacefully and filing a complaint? if the complaint lacked merit it was upto the govt to dismiss it. much as the paper has freedom to write whatver they want, those who feel offended have their own freedom of expression to protest or lodge a complaint per the law. and yes, people do have religious feelings and it is common decency to let others follow their religion in peace without their prophets or dieties getting humiliated in the press or in other public forum.

Nothing wrong with protesting peacefully or suing, but i am blaming the govt for arresting. The senas in the pub attack are sick individuals but in this case, it is the govt, which is supposed to protect people.

How is it freedom to write whatever they want when you yourself say that they cannot write anything they want. People has a right to follow religion just as much as people have the right not to follow the same religion. Lets say that i workship Sachin, then will the govt arrest someone who says that he shd be dropped ? Its absurd.....just as absurd as having no freedom of speech in a democracy. Just because some people get offended by words, doesnt give the govt any right to arrest people. Is it even the law?

Picked the following from another article: http://www.hindujagruti.org/news/2477.html ---The charges were made under three sections of IPC: Sections 295 (injuring or defiling place of worship with intent to insult the religion of any class), 295 (a) (deliberate and malicious acts intended to outrage religious feelings of any class by insulting its religion or religious beliefs) and 120(b) (criminal conspiracy). So I guess we do have laws regarding insult to religion. What constitutes a religion? That is a good question. Not sure if there is clear legal definition to distinguish hinduism/islam from sachinism. But if one has to go by common sense we all know what the answer is.

Thank you. I am astonished that its actually a law. I am ashamed to be an Indian today. Just noticed that saying the truth is now "deliberate and malicious acts intended to outrage religious feelings of any class by insulting its religion or religious beliefs"

Nahin bhaiyaa, religion ke naam par auraton ko log maarte bhi hain aur unki izzat bhi lootne ki koshish karte hain aur woh threads bhi yahin milenge, jo Mussalman nahin hote. Aur to aur toxins ka vyapaar bhi shuru kar diya hai.

As there should be. Without religion there is no India, it would be China. It doesnt matter what religion you belong to but your identity is definitely linked to religion. There should be rules and regulations in place to handle situations when people try to hurt others religious sentiments.

Actually it is pretty simple. The law will follow what is defined as religion, or what is acknowledged as religion by the law. Sachinism isnt, Islam is. And so if a case if registered against defaming Islam the Govt will have to take action. xxx

There are a bunch of other draconian laws in our IPC which make no sense whatsoever. Lurker, Nobody is talking about no religion being in India, it is about freedom of speech, the comparison here should be with the Western countries and not China, they have both religion and freedom of speech (atleast far far better than what is in India).

The term freedom of speech is used selectively by most people and therein lies the problem, me thinks. In my opinion every religion, in this case Islam, needs to be covered unbiasedly. Suppose Statesman was carrying an entire month covering Islam and Islamic issue and this article was just one amongst other 30, that would make for a very valid point. However it turns out this was only one article and pratically out of nowhere. Now if the Editor fights for his cause saying the Consitution grants him the rights, then religious minded people will also have reasons to level charges against him. In the end it becomes free for all. Half of the time the media covers things that are bad in a religion and Islam takes the beating most of the time. I would be very interested if an Indian media dedicated an entire month as Islamic studies, and see how many Indians really follow that edition. Would be delighted if Panchjanya did the same! xxx

Lurker, I agree there is a niche spot for some kind of media in India which is unbiased like PBS over here, sadly that is still open and someone can step onto it later on, but thats not the issue here. My issue with free speech is that, it should be completely free, be it against Islam or Hinduism or Chatrapata sivaji or the prophet or mother teresa, as long as it doesnt incite violence, everything should be game.

And I will agree to that in principal. I will also think that as a nation India is not there yet. We are deep rooted in our culture, religion, traditions and hence it is not easy to take any criticism as merely freedom of speech. Think it like this. These days India seems to be the flavour in the West. You will hear good things about India every 2nd day in the media. And so on days when India is criticized, or shown in bad light, people are indifferent to it since criticism comes with the territory of having won compliments. However articles like this form the part where only criticism is made and so for the followers of the religion it can give ammunition for being greaved. I do have issue against violence but if the followers sued on an Indian law that is well within their rights. xxx

The problem with that law is that, it is misused grossly so much that so, people ban orkut communities because someone criticizes Sonia etc. I do agree with the gist of your post.
