It would have been wrong to sell of a gift for profit after getting the duty waiver on the terms that it was a gift. It turns out FIAT paid the duty. So, SRT eventually got tax free income as some one mentioned that the Ferrari was supposed to be in lieu of compensation for some ad/campaign. Btw, have you got your form-16 for 2010-11? Just check the TDS column. Do you feel happy that you are not paying tax in crores or you feel sad that significant % of your hard-earned (I hope) money gets deducted before even reaching you!.

If FIAT paid the taxes, the government received the tax on payment for Sachin's services. If FIAT had paid him in cash, then the government would have received lesser income tax since the import duty is around 120%. The government is not at a loss here. Sachin only got tax free income because FIAT decided to pay the taxes. If my employer pays extra to cover my income taxes, I would also get tax free income without breaking laws.
