Do these defamation/libel cases ever get a result in India ? I have probably never heard of any such case ever going anywhere after the initial hoopla.
When was the last time someone won a libel in India against the government?
You guys are right. Seems the Indian government is quite immune.

We seriously need a change in the rape laws in this country.How can consensual sex become rape in hind sight?This law was probably made to protect gullible women from men who promise marriage in return for sex. These cases should be dealt with under fraud laws and not rape.These kind of cases make a mockery of the real rape victims.

A medical report submitted on Monday by the police in a court in Barasat after investigation confirmed Asian Games gold medal winner Pinki Pramanik to be a male. Based on the report of the medical test done by a board of doctors at the State-run SSKM hospital in Kolkata, the police filed a chargesheet against Pinki, now on bail, charging the athlete with rape and cheating as well as charges of holding out threats. Pinki was accused by her live-in partner Anamika Acharya of being a male who raped her, which led to Pinki’s arrest on June 14 and an order for medical examination to confirm the gender was issued. Pinki’s earlier reports of gender tests were inconclusive both at a private nursing home at Barasat as well as at Barasat General Hospital. The case was referred to the State-run SSKM hospital, but facility for chromosome pattern test was unavailable there too. Later, the test was concluded at Hyderabad, police said.

Whats interesting is that after the sex determination, the cops have booked her for rape. If they had to test her chromosom to determine her sex, I assume she does not have the male reproductive organ (please correct me if I am wrong). And if she does not have a male reproductive organ, how can she perform rape?

I had that question too but it turns out that the court had said that "rape" charge could not be applied unless Pinki was proven a male. I understand that the simpler thing would be to perform tests on Pinki's girl friend but since the rape charge is quite retrospective this was out of option.

I don't think his girlfriend made this charges immediately after the rape but after she had fallen out with him. Hence no question of testing her to prove the rape.

But if the person does not have a male organ, how can that person even perform rape on a woman?
