If they have not enough proof to make an arrest, how come they are so sure that he did consume the drug 12 times? Is consuming drug an offense?

Alcohol is still legal. Both have similar use. I dont know the actual difference as I have not taken any in my life, but both are recreational and can lead to addiction and used for intoxication.

Laws regarding alcohol consumption (and production sale, purchase etc) in India actually varies a great deal from state to state. To begin with, the legal drinking age is different in different states varying between 16 to 30. In some states, like Maharashtra, one needs a permit to consume alcohol, failing which one can be arrested, prosecuted and fined or incarcerated. In some states alcohol consumption is entirely illegal. In some other states, locals are not permitted to consume alcohol, but visitors are conditionally allowed. Most of these laws are archaic and exist only on paper and not in practice. However, sometimes cops can take advantage of such laws if it suits them.
