Why is the phony indictment filed by uncle tom Bharara taken to be gospel truth ? Case in point the allegation that Devyani confiscated the passport of the maid. This is clearly false. The maid was issued an Official Passport of India (distinct from the Regular Passport). When the Indian Government issues an Official Passport, the Regular Passport (if possessed by the person) is taken into possession by the GoI till the person returns from the official trip. The maid wanted her Regular Passport back (so she could emigrate to US) and she was told rightly by Devyani that she can get it only if she returns to India and surrenders her Official Passport (which cannot be used for emigration). Only someone unfamiliar with the passport rules can believe the nonsense of the maid's regular passport being confiscated by Devyani. It remains under possession of the GoI until the maid returns to India surrenders her official passport.

In case of Ktittika Biswas who was wrongfully arrested for a crime she did not commit - a different girl later confessed to sending those emails. Guess what, no action was taken by the NY police against this girl.

I should have reframed by sentence. Strip searches include cavity search and she was strip searched.
Read hhunaeh's post. She was not cavity searched. Anyhow, as far as I am concerned she was a corrupt, lying officer who clearly exploited her maid. Correct protocols might not have been followed, but there is nothing which happened to her which she did not deserve from a moral standpoint.

Protocols are protocols. They were not followed in this case. Its not a case of maybe. Thats the entire point. The entire justice system works on laws. you cant convict somebody even in the USA based on whats morally right. Quite frankly, the American media outlets need a reminder of what the USA did in the Raymond Davis case in Pakistan. I wonder what the wonderful people at the Washington Post have to say about that. or the fact that the USA have hidden one of the main accused in the Bhopal gas tragedy Mr Anderson despite official requests from India to have him face trial in India. Where is the moral standpoint there? They threw a tantrum when BP caused the oil spill. The American media outlets simply have selective memories.

Indictment is full of lies and the maid is a fraud. Devyani committed visa fraud means she broke their law, but offense is not a grave one for which she should be arrested, because of the position she holds. Her husband and children are American citizens (household salary would be good) and yet she took maid from India for $600 and didn't find one in USA. This is not ethical behavior imho. So, she was arrested for a few hrs (despite her position), I do not mind that. Nobody is stopping India from applying reciprocity. Infact, even US citizens would not complain if India arrested their consul general for any violations which we have been ignoring. We could have arrested the diplomat(if he wasnt immune) who let maid's husband escape on obstruction of justice.

Protocols have to be followed. Did you just read what US does in American schools?Violating laws openly.But in view of diplomatic courtesies and relations it was overlooked.

If a female is forced to open her cavities for visual inspection, that clearly qualifies as a cavity search by a reasonable definition of the phrase. Devyani was perfectly justified in claiming that she was cavity searched in the email she sent to her colleagues. This barbaric behavior by the US against a diplomat is a clear violation of the VCCR and Devyani should not even have been arrested given that the alleged crime was not a heinous one.

Diplomats are allowed to take helps from their countries.That is allowed under A-3 visa.

Yeah why would you give a feck about national rules of a top service being modified, tax payer money being swindled, or a poor person with no influence being exploited. All that matters is some national pride. Well, on the contrary I am ashamed that a person like her was representing India.

They should atleast have given $1600 pay. The 2 children ages 4 and 7 would have required quite a lot of work to be done by maid. This is why I do not mind her arrest for few hrs.

Then you are outsourcing your law to US and in process have assumed 2nd class status to goras. In that case, Bharara is right to doubt standing of Indian courts. Congratulations.

How do we know that the maid was underpaid ? This is just an allegation. There was no need to arrest Devyani in the first place. The same uncle tom Bharara delayed the indictments of the Russians until all the ones with limited consular immunity were out of the US. And that was a fraud of 1.5 million dollars !

You think 600$ plus fooding plus lodging plus mobile bills plus internet connection plus cable tv connection plus clothing plus medical all that in NYC would make it $9.75/hr?
