Sachin=GOD Posted April 12, 2012 Posted April 12, 2012 Anyone who thinks that a thing of the scale of Gujarat Riots can occur without the CM's knowledge/support is naive and doesn't know how the system works in India.

Take the case of Tytler - he was allegedly part of a riotous mob during the anti-Sikh riots in which an estimated 3000+ people were killed and for which, in the last 27 years, a total of ~25 people have been convicted. Even if you remove Tytler from the picture, it is clear that the judicial system has abjectly and totally failed in the case of 1984 riots. In the case of Gujarat 2002 riots in which a total of ~1100 people were killed, the justice system has definitely worked to some extent (much better than all previous riots in India). A total of 250+ people have been convicted of various crimes, and around 300 more are standing trial, including ex-ministers, MLAs, corporators, policemen. In a single case of the Ode massacre, just a few days ago 23 people were given life imprisonment. I am not saying that the process has been perfect, but it is quite irresponsible to negate the fact that it has worked much much better than any previous riot case in India. The media presence, technology, and bigger presence of NGOs (BTW, I am no fan of NGOs in general) has ensured that the incident stays in the limelight - you can't make an apple to apple comparison with the 1984 riots. A big difference is that in the 1984 riots even the small time goons got away, but in 2002 at least they are being punished. It has nothing to do with judicial effectiveness.

But this is what we call " chit bhi meri pat bhi meri" For me the credibility of the judgement can only be guaged by the rationale and evidence used as back up for arriving at it. I don't think nailing Modi without presenting credible evidence or judicial rationale would in any way enhance court's credibility. Justice system in India is crewed up. I don't think you will get an argument there from me. But I have faith in some judges and SC to some extent.

And before you bring in Tytler etc. - I've already stated my views on those mass murderers. As for Modi, and this is a completely personal opinion for which I cannot document any "fact", but a person I know was at a reputable post in Gujarat during those times and got the message conveyed in the lines of don't do anything - knowing him he has no reason to lie about it to me in a private conversation. Can I prove it? No I can't, but I have enough trust in that person to believe what he told me. Do I expect anyone to take my word for it or produce evidence? No! But at least let me have my well formed opinion.

Just saying that we have some great judges and SC as an institution still commands some respect and has credibility. Not saying things are not not bad though. Precisely why the matter has been put under SC supervision.

And why are they beyond the corruption that has led to Laloo and Tytler roaming free?
Sachin=GOD Posted April 13, 2012 Posted April 13, 2012 As long as Modi is in power in Gujarat, the courts/CBI/SIT etc will not find any evidence against him because not many IAS/PCS officers will dare to come forward for fear of severe repercussions but the day Modi steps down as CM you will see many witnesses coming forward to tell the truth. Modi has done very good work in Gujarat since the riots so I don't expect him to be out of power anytime soon but when he does, his bad days will start.

It is just because of his hugely successful image as well, then more attention is given to him now. And you simply have no respect for our legal system and still believe in your conspiracies.

It has nothing to do with judicial effectiveness.[/quote']The investigations are done by the police and the Supreme Court appointed SIT, and the judgments are handed out by special trial courts. And yet according to you ALL the credit should go to the media and the NGOs?? The fact of the matter is that the judicial system has definitely improved significantly since 1984, especially in the prosecution of riot cases. Case in point is the 2008 Kandhamal riots, which were on a smaller scale, but relatively speedy prosecutions have taken place away from the media spotlight as compared to Gujarat 2002.
