The court ordered a closure of the 12 units in the premises of the SEZ, as these had violated its earlier order of May 2012. A division Bench of Chief Justice Bhaskar Bhattacharya and J B Pardiwala held that APSEZ violated environmental guidelines by allotting land to individual units in the absence of the mandatory clearance under the Environment Impact Assessment (EIA) Notification, 2006. The court also directed the Union Ministry of Environment & Forests (MoEF) to look into the issue again within 30 days, after taking into account the high court’s observations and the Sunita Narain committee’s report that had pointed to violation of norms by APSEZ. In a statement, the Adani group said: “The Gujarat High Court has pronounced an order in a PIL against 12 manufacturing units in Mundra SEZ. These have been directed not to undertake any construction/ operational/ manufacturing activity till environmental clearance is granted... It is clarified beyond doubt that none of the berths at Mundra Port are affected by this order. The operations at Mundra Port are absolutely normal.” The scrip of Adani Enterprises slid 2.02 per cent, while those of Adani Port and Adani Power fell 2.94 per cent and 0.57 per cent, respectively. The court also dismissed a petition of Alstom Bharat Forge Power Ltd (ABFPL), a joint venture between French energy major Alstom and Bharat Forge, which had sought relief from the stay imposed on power equipment manufacturing project in APSEZ. The company, which has a 120-acre integrated manufacturing facility for turbine, generators and auxiliaries, in the SEZ, had to stop all its operations after a stay by the Gujarat High Court in May 2012. Senior counsel Mihir Joshi, representing ABFPL, urged the court to give his client some time, as it had pending orders. However, the division Bench rejected his request. A judgment was given on the PIL filed last year by people of Mundra’s Navinal village. The people had alleged activities continued in the SEZ, despite the high court in 2012 staying construction and further development activities by all units, including the Adani-owned units of APSEZ. The villagers demanded that all units be directed to stop operations till an environmental clearance was given to the entire SEZ. According to Anand Yagnik, lawyer for the people of Navinal, the court held that no construction or manufacturing could be done as it was illegal and unlawful in the absence of an environmental clearance. On the question of deemed clearance, as claimed by APSEZ, Yagnik said the court held the company did not have deemed environment clearance, either. “Deemed environmental clearance applies prospectively and not retrospectively,” he added. In the second quarter of 2013-14, on a standalone basis, APSEZ had posted a 19 per cent drop in its profit after tax (PAT), to Rs 347.62 crore, mainly due to an increase in operating expenses and forex losses. Its total income for the quarter stood at Rs 877.79 crore, up 15 per cent from Rs 764.27 crore in the corresponding period the previous year. On a consolidated basis, APSEZ’s PAT rose 24 per cent to Rs 342 crore, from Rs 276 crore in the corresponding quarter last year. The company’s total income for the quarter grew 55 per cent to Rs 1,149 crore, against Rs 740 crore in the year-ago period. According to APSEZ’s official website, the company was incorporated as Gujarat Adani Port Ltd (GAPL) to develop a private port at Mundra in 1998 but it started operations in 2001. The SEZ, Mundra Special Economic Zone Ltd (MSEZL), was incorporated in November 2003, merged with GAPL in April 2006, and renamed Mundra Port and Special Economic Zone Ltd (MPSEZL). The board of MPSEZL on November 21, 2011, approved the proposal to change the company’s name to Adani Ports and Special Economic Zone and the name change came into effect from January 6, 2012. So far there have been some totally impractical parts like income tax abolishing in favour of a flat rate Banking transaction tax. Now they might drop that proposal but still include "simple tax reform" If they are going to change income tax laws, then the middle class which is most affected by changes in tax slabs has the right to know what these changes are going to be.

He also talked about having a Railway University which is not at all a bad idea. Also few good and visionary things were having 100 smart cities and all of them having institution like IIT and IIM. He is focussing too much on skill development nowadays. He also talked about going ahead with River linking Project. On the other side Rahul talked only about how to revive Congress (some people are impressed only with the talk) and some fake aggression not sure about what he was actually annoyed. So for me atleast the choice is clear between Modi and Rahul.

I think at infrastructure front they already have good track record not only in Vajpayee era but also at the state level (especially Gujarat), so keeping our finger crossed we can trust them but yes they need to comeup with some good vision for economically and socially poor class. But isn't it the easiest thing to criticize Modi here, then go into Rahul thread and criticize him (infact laugh at him) and also nowadays criticizing Kejriwal ofcourse Mayawati, Mulayam, Jaya etc are not even in the contest so we will have to trust someone right? Or make it clear this is what I think and this time I will rely on following party or person. There is no one who is perfect but we have to trust Democracy right?

GANDHINAGAR: Ranjit Bannerji, chief executive officer (CEO) of Gujarat State Disaster Management Authority (GSDMA) and one of the senior most IAS officer of 1979 has been promoted to principal secretary ten days before his retirement. Bannerji has been promoted after almost 20 years. He is a batchmate of K Kailashnathan, chief principal secretary to chief minister Narendra Modi. A former managing director of Gujarat State Finance Corporation (GSFC), Bannerji was facing charges of allowing illegal and unauthorized upward revision of pay-scales to Grade-A officers, which caused a huge financial burden on GSFC and put it on a ruinous path. Meanwhile, four other secretary-ranked IAS officials of 1989 batch were promoted as principal secretaries on Monday. Those promoted are Pankaj Joshi who just returned from central deputation and is awaiting posting, Srinivas Katikithala, secretary of general administration department, Sunaina Tomar who is currently on central deputation and A K Rakesh, state development commissioner and in-charge vice chairman and managing director of Gujarat Maritime Board (GMB). I cannot vote anymore, so its immaterial but if i had the option, i would either vote CPIM or tick the 'anyone but Rahul Gandhi' column. If the choice is between Hitler and brain damaged idiot, I'd go with Hitler. For atleast, along with the immeasurable evil of Hitler (which Modi has also dabbled with), atleast we get a silver lining. With a total retard like pappu, we might as well open the border, tell the Chinese to take over and we'd still get more done !!
diga Posted January 22, 2014 Posted January 22, 2014 Interesting letter I saw, that was written to Mani Shankar Aiyar by a person called Bindu... nice one Dear Mr. Aiyar, I don’t know if I can even address you, as I have not studied in St. Stephen’s, I was born in a small nursing home in Tirunelveli, my great grandmother sold Idlis to make ends meet, my father-in-law was just a teacher, my husband didn’t have shoes when he went for his first job interview, I had just two pairs of clothes while growing up, I studied upto my 2nd standard in a school that no longer exists, Krishnan’s school also is no longer in existence, my father wrote accounts in a temple so he could fund his education and eat one meal, both my father and father-in-law started working at the age of 14… My husband and I currently live in a suburb of Delhi called Gurgaon, I am very worried if you won’t let me be here because we don’t “fitâ€, we aren’t from Doon school, Tripos college besides being from St. Stephens, we also have not been in the Indian Foreign Service for 26 years and we certainly don’t count Nehruji’s grandson amongst our friends, I don’t think we can speak English as well as you do, we will have to manage in Tamil, the local language and your forgotten mother tongue, in your constituency, Mayiladuthurai. Some things that we might have in common, either your friend’s family or your daughters would have used a L’Oreal shampoo, my husband Krishnan was part of the team that launched L’Oreal in India… Hmmm, I am racking my brains for some other connection. Krishnan started his career with Cipla, the Indian pharmaceutical company, setup on the behest of Gandhiji, the original Mahatma, not your friend’s father and you might have taken some medicine that they manufactured, but I doubt that. So we will continue to worry about not being in the same league. Mr. Aiyar, did you know that our second prime minister Shri Lal Bahadur Shastri was almost adopted by a milkman ? I guess by your standards he should not have become the PM, but should have supplied milk perhaps to all the Congress party workers. I wrote it in English so you would understand. Mr. Modi understanding or not doesn’t matter, he after all can just supply tea to Congress party workers. Mr. Aiyar, a question for you, can a person like me, who didn’t sell tea, or milk or any other food product, dream of being the Prime Minister or President of India ? Now that I think of it, Dr. Sarvepalli Radhakrishnan, one of our well known Presidents, also is from the non-existent school that Krishnan studied in and so is President V V Giri. Guess, both were mistakes according to you. Now Mr. Aiyar, if you still drink coffee that your forefathers drank at home, smell it, and find the first flight out to a country of your choice, because Mr. Modi will sell tea to the Congress party at a premium and from 7, Race Course Road as the PM of India soon, if not him, some other “chai wallah†or “jhadu wali†will be the prime minister, not the twit that your friend had for a son !! Just get out – we have had enough of your snobbery, and your corrupt party’s ways and really enough of your friend’s family.
