JAIPUR: Despite being banned for life by the cricket Board, former IPL Commissioner Lalit Modi on Monday defiantly filed his nomination for the December 19 Rajasthan Cricket Association elections, prompting a livid BCCI to threaten suspension of RCA for letting him back. Modi's nomination papers for the post of RCA president were filed by his lawyer Mehmood Abdi, who himself is aiming for the vice-president's post in the elections scheduled on Thursday. Abdi was accompanied by Amin Pathan, the secretary of Kota District Cricket Association and a close confidante of Modi, to do the paperwork on the last day of nominations. The scrutiny would be done on Tuesday while December 18 is the date for withdrawals. The polling would be held on December 19 between 11 am to 2 pm. However, a livid BCCI has a shot off a letter to incumbent RCA president C P Joshi, who has decided against contesting the polls. "We find that the Nagaur Cricket Association has allowed Lalit Modi as president. We wish to remind you that as per the BCCI rules and regulations, all the members, including RCA, are bound to follow the decision taken and directives issued in the interest of BCCI, especially those related to disciplinary proceedings," the letter from BCCI secretary Sanjay Patel stated. "The RCA stands to lose its rights and privileges as BCCI member if the expelled administrator of BCCI is allowed to remain an office-bearer of one of your district units. Therefore, kindly comply to BCCI directives and report the same to us," it added. As things stand, Modi can get elected unopposed in the polls given that nobody has filed a nomination for the top post apart from him. His faction already claims to have the support of 24 district units out of a total of 33. Modi was banned for life by the BCCI from all cricket matters in India after being found guilty of financial bunglings during his stint as IPL commissioner but the suspension was stayed by the Rajasthan high court in October only to be pulled back recently. Modi's legal counsel had claimed that since the RCA was governed by the Rajasthan Sports Act, the BCCI ban was not applicable on the former BCCI vice-president. "He has security concerns so we won't be seeing him here for some time but he can contest," said Abdi after filing the nomination. Asked if the RCA would be run with Modi in absentia in case he goes on to win the polls, Abdi said, "There is no need for him to be physically present all the time, he has a team under him and it can work under his guidance and leadership." "Even Mr C P Joshi was not there all the time in office, we can in fact count the number of days he was there in office," he added. It is worth recollecting that it was with the then BJP CM Vasundhara Raje, a Sports Act was formulated to pave way for Modi and oust the Rungta clan from RCA in the 2005 elections. With Raje taking over as Rajasthan CM, Modi seems to be regaining his foothold. There are 33 voters (districts) that make up the electoral list and only an office-bearer of a district association is eligible to contest the election. According to the Rajasthan Sports Act 2005 that governs the RCA, only the president, secretary and treasurer are the valid office-bearers.

He made his intent clear before rajasthan elections but he knew BJP was coming back to power there so thats the only reason i can think of him filing his papers now. when are the elections for RCA? if its after 2014 GE then he'll be able to easily walk in to india if hes namesake is in power

that makes sense... politics within the bcci is messing up a lot of potential talent from getting proper exposure... unfortunately that is how things will be unless something radically changes with the way the bcci functions.... another example is the state of bihar, which is one of the most populous states, does not even have an affiliation with the bcci.... how many talented cricketers are we wasting there?

RCA clarifies its stand to BCCI The Rajasthan Cricket Association (RCA) has sent a letter to BCCI clarifying its stand on the issue of former IPL chairman Lalit Modi being allowed to continue as president of Nagaur Cricket Association and subsequently contest the RCA polls here Thursday. The BCCI had banned Modi for life on charges of financial irregularities and it was livid by his intentions of clawing back through RCA. BCCI had threatened RCA with suspension and losing all benefits if Modi was allowed to contest the RCA polls. Officiating secretary of the RCA, K K Sharma, has written a letter to Sanjay Patel, Secretary of BCCI, clarifying that RCA is governed by the provisions of Rajasthan Sports Act, 2005, which is a legislative mandate holding the field in respect of Regulation of Sports in Rajasthan. “The elections to RCA are taking place in terms of orders passed by the Hon’ble Supreme Court in SLP © No.36140/2010,” the letter said. “The decision in respect of eligibility/dis-eligibility of any candidate including Lalit Modi to contest the forthcoming elections of Rajasthan Cricket Association has been taken by the Observers Hon’ble Mr. Justice N M Kasliwal and Hon’ble Mr. Justice S P Pathak, who were only entitled to take such a decision as per the orders of the Hon’ble Apex Court.” The letter said: “The Observers have rejected all objections raised against candidature of Lalit Modi and have by a speaking order permitted Mr. Lalit Modi to contest the elections. Robin Bist, Rituraj Singh and Ashok Menaria from the same RCA did make it to the India A squad in last 2 years. With Pankaj its either a case of someone higher up in BCCI being royally miffed with him or the North Zone selector not supporting him at all.

BCCI to wait for Supreme Court clarification on Modi ban

The BCCI has decided to seek clarification from the Supreme Court regarding its resolution to ban former IPL chairman Lalit Modi for life. The decision was taken at a working committee meeting on Saturday, in the wake of Modi's expected return to cricket administration as the Rajasthan Cricket Association (RCA) president. "The members decided that the BCCI must intervene in the SLP (special leave petition) filed by Mr. Rungta in the Supreme Court challenging the Rajasthan Sports Act and get clarified the position of BCCI to enable the enforcement of its resolution passed on September 25, 2013 expelling Mr. Lalit Modi," BCCI secretary Sanjay Patel said in a statement. While expelling Modi on multiple charges of misconduct, the BCCI had said, "he shall not in future be entitled to hold any position or office, or be admitted in any Committee or any member or associate member of the Board". Modi, however, got his candidature for the RCA presidency approved by the Supreme Court by exploiting a technicality that the RCA was governed by the Rajasthan Sports Act. The BCCI is likely to file an application in the ongoing case, filed by former RCA chief Kishore Rungta, in the Supreme Court before the next hearing on January 6. In the lead-up to the RCA election on December 19, the BCCI had warned its affiliate of severe consequences if they allowed Modi to return as an administrator. At Saturday's meeting the working committee decided to take severe action against the RCA, pending the Supreme Court's decision, but in a manner that would not harm the state association's cricketers. "It was further decided that subject to the decision of the Supreme Court, strict disciplinary action should be taken against the delinquent member while protecting the interest of the game in the state of Rajasthan," Patel said. According to a member who attended the meeting, while it was agreed the association had to be "taught a lesson", the board also agreed that it "shouldn't harm the players who are at no fault". Minutes before the working committee meeting was about to begin, Mehmood Abdi, Modi's attorney and RCA's deputy president-in-waiting, was prevented from attending. Following an RCA executive committee's decision to make a case before the BCCI, Abdi had flown to Chennai for the meeting. However, because the RCA isn't a member of the working committee and Abdi was not a special invitee, his request to attend was refused.
