Detonator Posted January 9, 2014 Posted January 9, 2014 A horrifying 'rape' tale has emerged that has enveloped the girl and caused death of the child A 16-year-old girl student allegedly threw her newborn baby from the window of her school hostel in the district following which the infant died, police said here today. The girl, studying in class X at a state-run residential school for girls, had delivered a baby boy in the early hours at the school hostel on Tuesday. However, the panic-stricken girl threw the newborn from the window of the hostel toilet, police said, adding that the infant died while undergoing treatment. "During the preliminary investigation, it was found that the girl's marriage was fixed with her aunt's son. When she had gone to her house at Pitlam mandal during the vacations last year, they had physical relations which resulted in her pregnancy," a senior police officer said. "The girl subsequently returned to the hostel and used to tell her teachers that she was unwell. However, she kept mum about her pregnancy and used to cover her stomach. Apparently, the nursing staff who used to conduct health check up also failed to notice it," the officer said. Police have registered a case under Section 315 of IPC (act done with intent to prevent child being born alive or to cause it to die after birth) against the girl, who has been shifted to a hospital for treatment. How do people not know? I think if the man is not minor then it is rape.....not sure. There was some point raised by women gps that sex between minors even if the girl is very young should not be considered rape.

What makes you believe that aunt's son was a properly adult man? I didn't see anything of that intent in the report. If two juveniles have sex why only one should be in jail?

If he is 17, he is let off for having sex , but the moment he turns 18 , he is expected to know the law of the land , and will be in jail for Rape case for having sex.

For 17+ juvi rapist in the Delhi Bus rape will get out in 3 years...rest are going to hang.

It's upto the judges to make the call based on the circumstances (media already named as panic sticken due to rape) and investigation with the girl. Anybody with some blood in heart can't throw a new born off a freaking window. IMO, the mother shld protect the child by any means and the girl shld ve faced it. I ve seen infants, they are small and helpless, how the hell anyone can just throw it?

On one hand the modern society wants to promote mixing of girls and boys on the other hand if they had physical relationship then you want boys should go jail and girls should be considered as victims. Read the news the boy has physical relation with the girl and that too after their marriage is fixed .In this case the actual people that should be punished are the parents of girls and boys who fix their children's marriage when the girl is not even 16 yet

Sex with a minor is considered statutory rape in many societies including many "developed" ones with "modern" culture. A 15 years old does not know her own good, does not understand the consequences of sleeping with somebody. She is not mature enough to take complex decisions on her own. That is why her guardians do it for her. The same applies to the decision to have sex as well. If an adult man sleeps with a minor woman, it should be rightfully considered rape. 16 seems the right age to me to draw the line.
