THANJAVUR: A 17-year-old student was detained and lodged in a correction home at Thanjavur in Tamil Nadu after he was found to have 'exploited' a 21-year-old woman with whom he had a relationship for over a year and fathered a child. The woman, who studies in a nearby college, met the teenager while living away from home with some relatives. In her complaint at a police station at Vallampudhur, a few kilometres from here, she said the boy lived on the same street as her relatives. Mani (name changed), an apprentice to a welder, had a relationship with Kavitha (name changed), who hails from Pudukottai, for over a year. Kavitha had moved to Thanjavur for college education. Mani had lured her with promises of marriage, but after an affair that lasted a year and left her pregnant, he began to avoid her. Kavitha after giving birth to the child had returned to Thanjavur from Pudukottai along with the baby and asked him to marry her. Mani is said to have avoided her, which in turn made her approach all women police station at Vallampudhur. Vallampudhur police, based on the complaint from Kavitha, picked up the boy from his workplace. Since he is a minor and not in a position to marry her, the police produced him before the Juvenile Justice Board at Thanjavur where both parties were heard. As per the orders of the magistrate Karthika, Mani was lodged in the correction home after an examination at the Thanjavur Medical College Hospital. Advocate Jayanthi Ranee, a former member of the local child welfare committee, said the minor could be released on bail and remain free during the trial. "Cases of such nature mostly get dissolved since both parties seek out-of-court settlement out of concern for the welfare of the child. Since the detainee is a 17-year-old, he has to wait for one more year if he wants to take a decision on seeking custody of the child and another four years to marry her," she said.

Yes. The Indian law holds that all women, regardless of their education, wealth, experience and accomplishments, are incapable of telling right from wrong. They are all naive, innocent, cant manipulate, do not understand the consequences of sex and are always the victims. Oh, the callous, cruel and manipulative men's world!!! That guy will now face rape charges.

Indian law in this case is perfectly fine.Although he gets away for being minor' date=' he would have faced rape charges had he been an adult and rightly so .[/quote'] How is having sex with a woman and then refusing to marry her is rape? by all means punish those men who cheat women , but is rape only word left to define whatever happen with woman.In TV debates some people were shouting that Somnath Bharati has committed rape, is this now the word rape has been reduced to ? I am sorry to say by putting most of crimes under the bracket of rape or sexual assault the greivance of real henious rape iwill get reduced

It is commonsense here that man gave a false assurance to have sex with her , beget a child and now running away from taking responsibility of the child. Of course if rape law is not suitable to apply here, have some other law which hands out punishment to the man. If you want to have sex, dont give false assurances.

This is the height of stupidity. Laying the blame on a minor while the adult gets away with it. The stupid idiot woman should be in jail for turning a minor into a father. Didn't the stupid B^%$# know a seventeen year old boy can't marry for the next four years.

If you want to have sex, dont give false assurances.[/quote'] How can a 21 year old woman not know that a seventeen year old cannot marry till he is 21 legally? Besides the adult here should take the responsibility for the sexual act just as an adult man has to take responsibility when he has sexual relations with a minor girl.

This is the price for letting people who believe in, "the way things have been, the way things should be" in human relationships, to have too much power. These people have rigid well defined roles for both men and women to play, and deviation from this is penalized. In this world with well defined roles , it is impossible for women to manipulate men. Adult, minor, maturity and all such things do not come into the picture at all.

India's age of consent for sex is 18 under the Criminal Law (Amendment) Act, 2013,[23][24] in-spite of a bill recommending the age of consent to be brought down to 16.[25] The bill has come under sharp criticism from many sects of society. The Kerala High Court, in 2004, succeeded in recommending the state government increase the age of consent to 18.[26] The Law Commission of India, has recommended the federal government raise the age of consent to 18 from 15, regardless of marriage.[27] However, none of those proposals have been considered by any of the (federal / state) legislatures till date.

How can a 21 year old woman not know that a seventeen year old cannot marry till he is 21 legally? Besides the adult here should take the responsibility for the sexual act just as an adult man has to take responsibility when he has sexual relations with a minor girl.
Legally this is a case which involves a minor and law rightly differentiates between a minor and an adult. My comments are for general cases where both adults are involved.
