instead of making it an open case like this' date=' they should have put a terror monitoring around these guys to see what else they are up to.[/quote'] That would've been too sensible for the chaddi brigade...

^so if some college students shouts slogabs & abuse some religion in hostel will that ok?
No, it won't be okay. But being not okay and being seditious are two different things. Its like saying you hate some guy, so next time that guy touches you, accuse him of attempted murder.

Again, those sedition charges are BS. You don't cause sedition by promoting the image of your enemy. Even in the 80s, you could stand outside the white house and yell 'long live Soviet Union' and not get booked for sedition. Sure, that put you on the FBI radar for monitoring, incase you did anything more and that should be the extent of it. Sedition is actively aiding the enemy of your nation- either by actions that directly harm your nation (eg: being their soldier, agent, revealing critical info to the enemy) or indirectly harm your nation ( eg: being a recruiter for your enemy nation). Simply saying 'long live the enemy' is not seditious.
yeah, "long live your enemy" is not seditious, but it is seditions if the enemy kills innocent people for fun.

His comments relate to who is being charged for what in India' date=' not an islamic nation. Your reply to him was irrelevant.[/quote'] true...but it was more in response to previous comments like "brainwashed few" which suggests he doesn't understand what many muslims may find offensive about secular or democratic non muslim states. also i am at work and not exactly having a freetime :)

For YOU to be charged with sedition, YOU must satisfy the charge, the nature of which i touched upon earlier. Saying you support them, is not direct or indirect help to your enemy. doing something about it, is.

The hindus did pretty much exactly the same to Buddhists and Jains, though on a lesser scale because hindu rajas were less united against the anastiks (buddhists and jains) than the muslim sultans were against the kaffirs. You don't get to learn that in history either. There is no difference between those who instigate riots and those who instigate terrorism. Both cause bloodshed and death of innocents. And last time i checked, we didn't go around making movies about Aurangzeb or Babur and making them into heroes. But we do make movies about Rajaraja chola, one of the single biggest killers in Indian history on religious basis.
We do make movies about Ghazini. No one knows who is rajaraja chola outside TN. yes, every freaking ruler has commited massacres, it's only a small fraction compared to the centuries of massacres and looting by islamic invaders.

False. And if you don't know who Rajaraja chola or Rajendra Chola is, thats basically saying you don't know who Chandragupta Vikramaditya is either. Maybe if you don't know major aspects of Indian history, you should stay away from forming such far-reaching opinions of what actually happened in history to our people...

Again, saying something doesn't count as seditious, but if you say with a rebellious act and say it in the presence of a large audience which potentially leads to a clash, the law has a right to take action.

so just by supporting another cricket team someone can become an anti-national element?

It's not for supporting the cricket team' date=' it's for shouting "Pakistan Zindabad", which could create hostility inside a college campus. The slogan promotes rebellious acts.[/quote'] Let's just hope that they didn't say those slogans and the news is made-up.

Again' date=' saying something doesn't count as seditious, but if you say with a rebellious act and say it in the presence of a large audience which potentially leads to a clash, the law has a right to take action.[/quote'] They did not say it with a rebellious act because they are not recruiters, neither did they finish their statements with such as ' and if you agree, join us here' type statements. There was no rebellious act. You cannot prosecute someone for a crime that has not happened. IF someone said it on stage to a large audience and the audience went around after the speech comitting crimes, then and only then can you charge someone for incitement. But i said a whole bunch of things to a thousand people, then the people went home and nothing happened, is not incitement. To say otherwise, is to put curbs on freedom of speech, which the indian constitution garantees. Our constitution puts restrictions on free speech when it relates directly to religion and encouragement to take action against the nation. 'Pakistan zindabaad', as a statement, does not qualify on any such grounds. You simply want to punish people for saying something you don't like. It simply does not work that way in any nation that is not a tinpot dictatorship or isnt in the practice of using hocus pocus books written thousands of years ago by illiterate people as its basis to law.

I have to agree that this is a good post, just I beg to differ in the context of this thread. The headlines say "Students face Sedition charges for supporting pakistan cricket" but only few sites point out this incident. The below act should be the one that initiated chargers.
Sources in the varsity said that only "10-12 Kashmiri students'' were involved in the cheering, which involved sloganeering of "Pakistan Zindabad" and many students taking off their shirts and running in the campus to celebrate the Pakistani win. Their acts caused resentment from the other students, following which the two groups clashed resulting in stone pelting and vandalism in the hostel. The students alleged the university was "biased" and they were not given any opportunity for explanation, even as the varsity said it would re-induct the students if they rendered an unconditional apology. The students were sent home as a "pre-emptive measure" and out of "fear that the on-campus violence could snow-ball into communal tensions across the city," which is known for its volatile situation, varsity VC Manzoor Ahmed said. "It was foolish youth exuberance. But the sloganeering was dangerous and we feared violent repercussions," added Mr. Ahmed, who acted against the Kashmiri students. The students are pursing law, business administration and technology courses in the varsity and some of them are recipients of the Prime Minister’s scholarship for Kashmiri students.

Quite frankly I don't care about punishing or soliciting the Kashmiris. Pundits have been slaughtered and displaced from their lands. Kashmir is now merely an ego issue. Pakistan is in shambles and if these jokers want to go with them, so be it. I don't accept the idea of forcibly holding on to them when they feel a certain way. I suggest hold a plebiscite and part Kashmir among those who wish to say. Quite frankly, this issue will keep holding us back.
