Dhoni is screwed up now that SC has proved he tried to be a obstacle in the investigation by faking few things.At the end of the investigation i wont be surprised if SC gives him some punishment. We had Azhar as captain once and now it is sad to see Dhoni lead the Indian team.

It's not. Salve is making a prosecution charge (his job) by reading the Mugdal report. The language used in the report still leaves room open for interpretation. A deposition is usually recorded but there's a chance that it wasn't recorded (refer post C_G earlier).

The report is publicly available. Here's what the report says
Further, Mr. M.S. Dhoni, Mr. N. Srinivasan and officials of India Cements took the stand that Mr. Meiyappan, had nothing to do with the cricketing affairs of Chennai Super Kings and was a mere cricket enthusiast supporting CSK.
The key word here is the definition of "cricketing affairs". What does it mean? IMO, Dhoni is skating on thin ice here.

Yes the fact that all the actors in the report are clubbed together and 'nothing to do with the cricketing affairs+mere cricketing enthusiast' is being attributed to them collectively - suggests very strongly that there isn't much variance amongst whatever they said. Otherwise the ex CJI would have made it explicit - this should nail ms and this is precisely what salve was arguing - I wouldn't even say arguing just restating what the report lays out frankly.
The problem is we don't know what "cricketing affairs" refers to. Prima facie, Dhoni seems to have lied which is bordering on perjury.

BCCI should be questioning Dhoni, not defending him Harish Salve, the lawyer for Aditya Verma, the petitioner in the Justice Mudgal Committee report case, pointed out that it is there in black and white in the committee report that Dhoni tried to cover-up Gurunath Meiyappan's role in Chennai Super Kings. "The report records that Mr Srinivasan, MS Dhoni, vice-president of India Cements, and other officials who appeared before the committee insisted that Meiyappan is only a cricket enthusiast," Salve told CNN-IBN. "The committee found Meiyappan would sit in the team dug-out. Surely Dhoni knew that. Meiyppan would bid for players at auctions. He probably bid for Dhoni. Surely Dhoni knew that." Salve went on to point out that the definition of corruption in the BCCI's own anti-corruption code includes a cover-up, and on those grounds the BCCI should be summoning Dhoni for questioning, not defending him. The BCCI, by defending Dhoni, is again compromising its position," Salve said. "It is supposed to be the disciplinary authority. If someone has made a wrong statement, the BCCI should call him and ask him why he said this."

Someone should explore the conflict of interest of Salve. He sounds like a guy with vendetta and axe to grind.
That's a weird proposition. He's a legal counsel and has complete right to be hired as one.

Well, he goes from someone potentially lying when asked an ambiguous statement about "cricketing affairs" to declaring the guy corrupt. I say he should be held for contempt of court for lying himself. :winky:

LOL.Now the counsel for prosecution must be investigated for levelling charges againist Dhoni.LOL thats the job of the prosecution.Some Chuski/Srini/Dhoni fans are too much.Just blinded. Having said that i doubt Dhoni can be tried for perjury as these depositions were not made under oath nor is the Mudgal committee a legal agency like Police or CBI.

Thanks for info about dhoni this so first time I am hearing.. I honestly think no person in world would have said the truth..even hussey changed statement Srini just has way too much power

WEll obviously not no person but at his position I can clearly see why he would have lied if he is punished fine but to me it's understandable and this is what happens when one man is president of bcci and has say even in selections and owner of his franchise and is going to be icc head :giggle: Why did mike hussey change statement ? I am well aware it was just in media but what made him do that ? If they punish dhoni and not srini then IMO it will be very unfair

It does not matter. Dhoni wasn't under oath. But does that make life any easy for him? Nope and here is why: That deposition was done in an investigation by the Mudgal committee which was authorised by the Supreme Court itself. Here's Explanation 3 under Section 193 of the IPC that covers the punishment for false evidence: "An investigation directed by a Court of Justice according to law, and conducted under the authority of a Court of Justice, is a stage of a judicial proceeding, though that investigation may not take place before a Court of Justice." And the section 193 lays out the punishment. "Whoever intentionally gives false evidence in any of a judicial proceeding, or fabricates false evidence for the purpose of being used in any stage of a judicial proceeding, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine." Explanation 1.- A trial before a Court- martial 1[ is a judicial proceeding. Explanation 2.- An investigation directed by law preliminary to a proceeding before a Court of Justice, is a stage of a judicial proceeding, though that investigation may not take place before a Court of Justice. Illustration A, in an enquiry before a Magistrate for the purpose of ascertaining whether Z ought to be committed for trial, makes on oath a statement which he knows to be false. As this enquiry is a stage of a judicial proceeding, A as given false evidence. Explanation 3.- An investigation directed by a Court of Justice according to law, and conducted under the authority of a Court of Justice, is a stage of a judicial proceeding, though that investigation may not take place before a Court of Justice. Illustration A, in an enquiry before an officer deputed by a Court of Justice to ascertain on the spot the boundaries of land, makes on oath a statement which he knows to be false. As this enquiry is a stage of a judicial proceeding, A has given false evidence.
