Modi govt. seems determined not to let AAP govt. work properly. This arrest was absolutely unnecessary and has been effectuated just to break the rythm and morale of AAP govt. Looks like BJP doesn't want even 3 seats in next election. They'll be taught even better lesson.
Detonator Posted June 9, 2015 Posted June 9, 2015 Delhi Law Minister Jitender Singh Tomar was arrested on Tuesday on charges of cheating, forgery and getting jobs on fake degree. Tomar has been charged under various IPC sections including 420 (cheating). He has also been charged under IPC sections 467 (forgery), 468 (forgery with purpose of cheating) and 120 (B) (criminal conspiracy). "Law" minister
Detonator Posted June 9, 2015 Posted June 9, 2015 Raghav ji, Bar Council of Delhi filed the complaint, and they did issued a noice to JST to file his response. Why is Modi being dragged into AAP stinkers ?

Why is Modi being dragged into AAP stinkers ?[/quote'] Arrest of a person is discretionary matter unless there is prima facie evidences of a heinous crime or there is flight risk. In this case, police could have taken complaint and started investigation. There was no need to make arrest. It is not plausible that Delhi police would have taken that decision itself without taking direction from home ministry whom it works for. There seems to clear campaign by BJP govt to paralise AAP govt.
amiret Posted June 9, 2015 Posted June 9, 2015 There have been numerous instances in Calcutta University where the records of students who had graduated were found to be missing, incorrect OR linked to some other roll/serial number. Wasn't the matter pending before the High Court ?

JST can be arrested with just IPC secton 467, as the university degrees are considered as valuable securities. The punishment is upto 5 yrs imprisonment I guess.

Wasn't the matter pending before the High Court ? I think matter was already sub-judice. I don't see any logic in this arrest other than motive of humiliation of popular AAP govt. Some very wrong and dangerous predences against basic democratic strucrure are being set.

Even if there is arrest was defintely not necessary.
amiret Posted June 9, 2015 Posted June 9, 2015 May 29th 2015 : senior advocate AS Chandhiok who appeared for Tomar mentioned the case before Justice Rajiv Shakdher who posted the matter for Wednesday. Chandhiok said Bar Council Delhi should give more time to Tomar to file certified copies of his degrees. He further told the court that BCD has not provided him copy of the inquiry report against him, adding that the report has been forwarded to the Delhi Police instead of giving him. :hmmm:

mishra Posted June 9, 2015 Posted June 9, 2015 May 29th 2015 : :hmmm: On May 9, the Bar Council of Delhi (BCD) had sent a complaint against Tomar to the Delhi Police for inquiry into the authenticity of the certificates submitted by Tomar at the time of his enrollment. The Council had given one “last opportunity†to Tomar to submit the original certificates of his undergraduate and postgraduate studies and LLB by May 27. Tomar’s advocate had sought time till July to file the certificates, but the BCD declined his request. - See more at: http://indianexpress.com/article/cities/delhi/delhi-police-arrests-jitender-singh-tomar-in-fake-degree-row/#sthash.4C5o7Wsn.dpuf

G_B_ Posted June 9, 2015 Posted June 9, 2015 seems deto has made the points i was going to make.... so +1 to all what he has said from me.
G_B_ Posted June 9, 2015 Posted June 9, 2015 from a purely political POV and even a governance POV i have to ask has Tomar like been an actual practising lawyer? Got to feel sorry for the plaintiffs who selected him as their representative. Surely he must have a certificate which can be authenticated a mark sheet and even batch matches who knew he was a part of class or something (or was it distance learning) Ie he can have some sort of correspondence right? Reminds me of Suits (the series)
asterix Posted June 9, 2015 Posted June 9, 2015 There was no need for an arrest. Tomar was not evading the law. A case is already in Court. The Court has not directed DP to arrest JST... It's not a big crime that he's to be arrested...
mishra Posted June 9, 2015 Posted June 9, 2015 ^ You can be a law minister without having a degree in law. I think issue here is slightly different. Once you finish LLB u become a member of Bar Council. However, If he has provided a forged certificate to become a member, then it will be considered a major breach and hence heinous crime

Reminds me of Suits (the series) Bolded part is exactly the reason for arrest. The Bar council issues a certificate of practice after registration which the advocates frame it and hang them on the walls in their office to public.
amiret Posted June 9, 2015 Posted June 9, 2015 It is being reported that Tomar is not being allowed to meet his lawyer . Since my knowledge on legal matters is nil : Doesn't the accused have a right to counsel even during custodial interrogation ?
mishra Posted June 9, 2015 Posted June 9, 2015 It is being reported that Tomar is not being allowed to meet his lawyer . Since my knowledge on legal matters is nil : Doesn't the accused have a right to counsel even during custodial interrogation ? Isnt He himself a lawyer?
Detonator Posted June 9, 2015 Posted June 9, 2015 Isnt He himself a lawyer? fake lawer. That's again an offence and police has to arrest him again. :giggle:
