SachDan Posted January 7, 2012 Posted January 7, 2012 rett, are you under house arrest or something of thing of that sort? if not go outdoors and chill out with friends (I take there aren't many) man..of late you comes across as one who's deprived of public life :(
Mariyam Posted January 7, 2012 Author Posted January 7, 2012 Rett, see my response to PravinKataria Your arguement essentially hinges on the "officialness" of Shastri's Audi. The Audi may be a legit/official/recognized/sanctioned/licensed (take your lexical pick) prize as per the various cricketing bodies of the world. But why should a government distinguish between prize that a cricketing body awards a cricketer for his feats on a cricket field and the 'gift' a non cricketing body awards a cricketer for his cricketing feats (not as clearly defined)? Thats a fair question. The stand of the Government of India: The Customs Act currently treats 'gifts' won by Sports persons as prizes. That is debatable for a whole host of reasons ( refer post #31) , but that's beyond the purview of this discussion.

Prakat Posted January 7, 2012 Posted January 7, 2012 Not disagreeing with any thing you say, but when you say 'established contest' , for whom is the contest established? The BCCI/ICC or the GoI? Let me put across a hypothetical scenario to you, since its morality that we're discussing: India won the T20 world cup (a very tangible and quantifiable victory, unlike the Bradman record) in England. A rich Brit Indian, who has nothing to do with the BCCI gifts each team member a mini cooper. Do you think they'd be justified in asking for an import duty exemption in taking the cars back home? The World T20 championship would be an example of an established contest. If we start from the premise that laws are there to protect us from the worser aspects of human nature. And if I had to argue against the granting of exemptions for the 15 odd Mini Coopers. I would argue what if these Minis were part of a deal to reacquire them once they are in India and then were sold to the general public by the Brit Indian's Indian business partner. The Mini being imported now start at 25L after duty. 15 duty-free Minis would be a considerable loss to the GOI. And once that is done, the Brit Indian could then wait for the next Hockey, Olympic and Cricket victory overseas to repeat his deal. I would suggest that in all such special cases of duty-free imports, the beneficiary has to keep the item for his or her personal use for a stipulated period.
