Some low stuff from BCCI, really the egos of some of these guys who're incharge of Indian Cricket is bordering on disgusting.

Even as uncertainty prevails over whether Kapil Dev has been left out of the list of former cricketers due to receive the one-time monetary benefit by the BCCI, the former India captain has said officials of the Cricket Board are the "boss" and it's their call to make any decision they want. "They are the boss. Let them do whatever they want to do. What is the point about talking on this matter" Kapil said on Wednesday. The 1983-World Cup winning captain was not invited by the BCCI for the functions at the four IPL venues where it is set to honour former cricketers with cheques for their services to Indian cricket. Kapil played 131 Tests and 225 One-Day Internationals for India and is rated among one of the greatest all-rounders to have played the game. He is entitled to get 1.5 crore from the BCCI as per the scheme. "I am a content person and these things will not bother me. I enjoyed playing for India and that is it. I do not have to do anything more. I do not feel comfortable in talking negative. I am a very positive person and I do not have to talk about negatives." It is believed that Kapil was ignored by the BCCI as he had not accepted the amnesty offered by the board following his involvement in the Indian Cricket League -- the now-defunct Twenty20 league. While a senior BCCI official insisted that Kapil's name figures in the list of beneficiaries, some other officials said he was ignored. The Board had released the list of 65 players invited to collect their cheques at the four venues, but the entire list of beneficiaries has never been made public. "I wish them (BCCI) all the best. They will not come to me (as) they are the Board. Let them do whatever they want to do. What is the problem in that? Try to understand that if they want to do something let them do."

Kapil should have filed case against BCCI. Should have gotten the money and then donate it. Would have been great. BCCI should have acted as professionals. but thats too much to expect.

Though I dont agree with the exclusion of cricketers who didnt get along with the BCCI, any legal recourse wouldnt yield much. BCCI is registered as a private body and the handouts were done voluntarily by them to honour previous generation of Indian cricketers- they werent bound by law to do so. Leaving out Dev and Azad is morally reprehensible, but not illegal to be challenged in court.

BCCI is a private body,so does that mean they can do whatever they want without accountability to anyone,then how is the team run by the BCCI allowed to represent india,should it not be BCCI XI?

They dont have any obligation to do that and when they do even people complaint. See the positive of 150 cricketers benefited and even if they left 2 whats the big deal.

Kapil Dev is way above the BCCI, has enough money, and is recognized the world over as one of the greatest all rounders ever. It's the BCCI which continues to make itself more and more petty by such decisions.

If tomorrow they organize a benefit match for one cricketer, others cant challenge that in a court of law citing discrimination.

Discrimination is just that. Ofc the company can argue that you were excluded because you did this bad thing with a rival company, etc and the courts can decide it that merits an exclusion. In the US, several years ago, Microsoft contractors sued the company saying they got no benefits including company stock even though they did their job just like other employees. This later caused an IRS rule change with respect to contractors/employee status. I think those guys won, although I am not certain.

Agreed. And Sunil Gavaskar & Ravi Shashtri, both of whom clearly don't need the money, should have been vociferous in denouncing BCCI's action and question it. Specially Sunny Gavaskar who shows up everywhere on 1983 WC celebration and collects fat pay check. And Indian cricket fans, not the website, should have been up in arms on disrespect of one of the greatest cricket players ever, and by many accounts the greatest Indian player. But clearly that did not happen either. So maybe Kapil did the gracious thing here. He doesnt need the money and doesnt need to stand up for nonsense. More so in the era where an Indian cricket fan forgets 0-8 and already spends more time following retarded IPL than Kapil Dev. So it all works out in the end for everyone. :two_thumbs_up:

Lurker, I disagree that Kapil should file a law suit against the BCCI. Kapil's stature is way above the BCCI and he certainly won't be doing it for the money. It will be equivalent of demanding respect from your proverbial gali ka kutta - really, I am not one bit disappointed that a corrupt and self indulgent organization like the BCCI did not recognize his services to Indian cricket.

If Kapil went the legal route, and I doubt he ever will, it would not be because of money. He had made millions in his own cricketing times and does not really need the money. In fact I am reminded of a comment I once read from Ian Botham that perhaps the reason why Kapil was so fearless and cavalier was because he did not really had to worry much about money. I may have misread it a bit but I suppose that was kind of a dig on why Kapil often flummoxed his supporters with half-hearted attempts, specially in county circuit where he didnt exactly set the world on fire. Back to issue at hand though. He doesnt need it for money, and clealy BCCI has a certain agenda here namely to buy goodwill. Kapil's act would be more about principles. And how does one contest that? But of course in India everybody can knock a great, Jagdale, Srinivasan and Rajeev Shukla have all reasons to feel bigger than Kapil. :winky::winky:

This later caused an IRS rule change with respect to contractors/employee status. I think those guys won, although I am not certain.
There is no law being broken here and Kapil and other cricketers werent under contract when the payments were made. Secondly, BCCI is not bound by law to distribute these amounts. That they are doing so is entirely on their own volition. It was a one-off goodwill gesture that the BCCI chose to distribute only to those cricketers who were in their good books. This is just like benefit matches, some cricketers got it, many didnt. Yet the ones who didnt dont have any legal ground to challenge the choice of cricketers. If a contracted cricketer is not paid the bonus that others got, then he is entitled to sue the employer (BCCI), but the employment of the cricketers got over long ago. One can appeal to the moral sense of BCCI that it owes these payments to Kapil and others as well, but its not a case that will stand in a court of law
