seedhi Posted February 2, 2014 Posted February 2, 2014 You initially spun it off as Gujarat govt relentless pursuit of a case via the judiciary and SC ruling in its favor. As it turned out' date=' that wasn't the case - why so defensive? You were wrong, may you didn't read it, may you misinterpreted it or whatever. But if you [b']feel you are right on each & every thing you post let me know NOW, I wouldn't care to respond. I am not, won't be right everytime and a discussion is the only way to point that out.It is your prerogative to respond or not respond. If I am wrong you have every right to point it out. What I "feel" has got nothing to do with you. In my case, the point was you are indulging in "hasty generalization" - picking up the dharna example. You could easily pick other examples like - CAG audits for discoms, DJB policies, SC move against CNG prices etc. which are well within the legal & constitutional framework but you specifically pick the dharna and generalize. Now, you didn't like the dharna fine, state it and move on. Oh and btw, a dharna is not "unlawful" - everyone reserves a right to protest including you and me under Article 19. Before calling it "unlawful", you may want understand the legal repercussions behind it since following the judicial system is of utmost importance, it seems.I did not say every dharna is unlawful. I called AAPs dharna unlawful, because it broke the law i.e. section 144 for which an FIR is also filed. I have made it clear that what I oppose very strongly is Constitutional authorities resorting to open law breaking, calling themselves anarchists, threatening to disrupt the republic day etc. If Kejriwal knew that he would be breaking the law then why did he swear an oath to uphold the rule of law ? He is an open liar.

His responses don't seem calibrated. Governance is cool man's game. He seems emotional and prejudiced. His voters equally so. Nobody thought this through. But now that we are here, we don't know what to do. But we have to do something. My advice to Kejriwal will be to take a break of 2 weeks away from this frenzy. Think things clearly. Right now it all is so reactionary.

What I "feel" has got nothing to do with you. Thanks, appreciate the highlighted part. So, as far as I am concerned the Gujarat govt has had no role in the PIL. I did not say every dharna is unlawful. I called AAPs dharna unlawful, because it broke the law i.e. section 144 for which an FIR is also filed. I appreciate that concern. The only problem I have is that the at every moment when Section 144 has been filed against them, the BJP have hinted the Congress of being dictators etc. Be it, Baba Ramdev's protest at Ramlila Maidan or BJP team visiting a riot-hit Hyderabad. In the past, there have been prominent BJP leaders who have violated Section 144 btw like Varun Gandhi, Jaitley, Rajnath Singh, Mukhtar Abbas Naqvi etc. Anyways, the SC has clearly stated that a constitutional authority in the Gujarat government has clearly violated laws by acting as a dictator, arbitrary etc. The person is next in line to the CM of Gujarat. I expect you to oppose that very strongly too.
adi B Posted February 2, 2014 Posted February 2, 2014 Huge rally in Meerut today... :hatsoff: sad it went unnoticed on this thread.he took a jibe at sonia's "zeher ki kheti" comment :cantstop: .. actually modi is conducting some important rallies in the cow belt region which has to be a massive gaining area for BJP

The CM of Delhi knowingly and deliberately broke the law, he himself said that he will disrupt the Republic Day.
Crookbond Posted February 3, 2014 Posted February 3, 2014 None of them were Chief ministers, i.e. holders of constitutional executive posts. Our constitution defines the law to be equal to everyone - no holds barred. Anyways as per my understanding, MPs (named some of them) are as much part of the "constitutional executive" as anyone else. Also, not every Section 144 is "correct" and many a time the SC has called it out so. The CM of Delhi knowingly and deliberately broke the law, he himself said that he will disrupt the Republic Day. May be you didn't read the SC judgment but it clearly says "acting like a dictator" and "arbitrary use of power", "dereliction of duties", "arrogance of power" and "holding her high above law" etc. It's a damning verdict for disregard of law and acting against the statute as said by the SC judgment. Anandiben Patel knowingly went against the Ministry of Revenue secretary based on a letter from her party's high command. This is not "ministerial discretion" but violation and utter disregard of the rules as pointed out rightly by the SC.

And the (main) reason is that there is no evidence of bribery or gratification. What Kejriwal did was open and deliberate violation of the law.

And the (main) reason is that there is no evidence of bribery or gratification. What Kejriwal did was open and deliberate violation of the law. The SC said that she deliberately acted against the rules even after been advised by the Land Revenue ministry. That was in her complete knowledge - that may not be prosecutable but that doesn't mean her act was not arbitrary or dictatorial as the SC mentions. Prima facie, Kejriwal has indeed violated the law but there is a question mark on the imposition of Section 144. In the past, there have been many instances of violation of Section 144 but the court has not taken any action as the imposition was arbitrary. Time will tell.

asterix Posted February 5, 2014 Posted February 5, 2014 There's definitely a pro Modi wave going on in UP of whatever local opinion I've followed on TV... UP and Bihar could give BJP a decisive edge to cross over the magic line...

UP and Bihar could give BJP a decisive edge to cross over the magic line... Yes, A good number of votes in UP and Bihar, but BJP alone getting 272 is being far too optimistic, even more than expecting India to win a test series in South Africa and England. At best, they will reach 210-220 and that in itself is praiseworthy :hatsoff:
BeautifulGame Posted February 5, 2014 Posted February 5, 2014 BJP will do well to get 200 seats which should be enough to form coallition govt.Anything above is unlikely in present scenario. 220+ is pure fantasy . Media are typically getting carried away with pre poll predictions .Should remember what happened in last 2 polls(2004 & 2009) with similar pre poll predictions.
