:clap:... wait a minute. what for? Did they let go rest of the murderers (on trial) in jail for holidays?
Keeping people in Jails while they have not been convicted is no fun and should be discouraged. High court was reasonable sure in this case that enlarging them on bail would not harm the judicial process and they would be avaialble for court proceedings whenever required, so they were allowed to go to Italy. Nothing wrong with that. However I agree that courts should use such discretion in common men cases as well.

That is why they were given bail but asked to remain within Kerala. Letting people who are being tried for murder out of the country is ridiculous. Would an ordinary criminal be allowed the same courtesy?

If courts are reasonably sure that person being tried a) will not run away b) not a danger to society c) won't impede judicial process through threatening etc, then they should not be detained until they are found guilty by Court. On these grounds, there was nothing wrong in letting them go to italy or anywhere in the world. It's unfortuante that such discretion is not used in many other cases but that doesn't make letting these Italians go out of country wrong.

They are not Indian citizens. They are employees of Italian Goverment. Thats how dimplomacy works in the civilized world

Is he a goverment of India employee? Will the goverment request US to do so?
That doesn't make sense. The govt is supposed to treat all citizens equally except under special circumstances & a Christmas holiday isn't one of them. If it was 1 Italian security guard of the merchant navy arrested in a similar incident, would they let him live in jail and not petition for him ?

International diplomacy irrespective, this doesn't look right to me. While one can understand the Italian consulate's interest in this (persuaded by public sentiment in Italy I guess), what does the Indian govt have to gain by letting these undertrials off for holidays, unless its an underhand deal.

Let an Indian soldier be tried for murder in the "civilized world" and request permission to leave the country. We'll see how that goes. The soldiers were on bail, their families were free to come and visit them and celebrate christmas with them. That is about as much concession any court should give them.

Marines who shot dead two Indian fishermen to stay in Italy

Rome: Two Italian marines charged with killing two Kerala fishermen in sea waters last year will stay back in Italy, the foreign ministry of Italy announced today. Marines Massimiliano Latorre and Salvatore Girone were allowed by the Supreme Court in February to go back to Italy for four weeks to vote in elections. Italy voted on February 24-25. It was their second visit after the Kerala High Court allowed them a two-week home stay during Christmas last year. The Italian government had given an undertaking in the Supreme Court that Massimiliano Latorre and Salvatore Girone will return to India after the voting.
Who the hell lets people under trial return to a foreign country to vote in local elections. This has to one of the biggest **** ups by our foreign ministry and supreme court

And why is it wrong when the Italian consulate and ambassador have vouched for their return?
The ambassador/consulate's word means quite a bit I would think .. unless the high court & govt both went rogue' date=' the Italians cannot afford to mess with us. So lets just see what happens two weeks from now.[/quote']
