Disqualification clause is attracted only if convict gets 2 years or more. So technically Lalu is yet to be disqualified, even though for him minimum 3 years is confirmed.

Raghav_12 Posted October 2, 2013 Posted October 2, 2013 Isn't it 4 years minimum? Charges for which he has been convicted for attract punishment from 3 to 7 years. Some of the convicts have been given 3 years and those were announced on 30 itself and were given bail same day. For rest of the convicts it is being assumed that they'll get 4 years or more. In that case bail would be given by high court.

His not getting bail would have been more illegal than him getting bail. World over it works like that. Berlusconi in Italy in outside jail despite getting convicted. Rajat Gupta in USA is out despite being convicted. Pendency of his appeal in HC Lalu should be outside jail and so rightfully granted bail. Sanjay Dutt is anyway different case. He is definitely misusing his influence to go out on vacation time and again.

There were 44 accused in the case and 37 of them have already been granted bail and bail application of six others is under consideration of the trial court. The court noted that out of five years' jail awarded to Lalu, he has already undergone one year of the sentence in two phases, which included incarceration for 10 months during the course of trial and another two months since he was convicted and sentenced to jail.
