Asim Posted June 19, 2012 Posted June 19, 2012 Pakistan's top court has disqualified Prime Minister Yousuf Raza Gilani from holding office, two months after convicting him of contempt of court. The Supreme Court ruled he had "ceased to be the prime minister of Pakistan". In April, the Supreme Court convicted Mr Gilani of failing to pursue corruption charges against President Asif Ali Zardari. He had argued the president has constitutional immunity from prosecution. But Mr Gilani was given only a token sentence and spared a jail term. Tuesday's court ruling disqualified Mr Gilani from office and from parliament. "Since no appeal was filed [against the 26 April conviction]... therefore Syed Yousuf Raza Gilani stands disqualified as a member of the Majlis-e-Shoora [parliament]," Chief Justice Iftikhar Chaudhry told a packed courtroom. He added: "He has also ceased to be the prime minister of Pakistan... the office of the prime minister stands vacant."

Iftikhar to get restored, we have one completely independent and extremely efficient judiciary, they rather gave PM so many chances to avoid such situation, 2 months ago supreme court convicted PM and gave him one symbolic sentence assuming PM will resign right after that but PM & Parliament (under Zardari instructions) un-necessarily kept on showing resistance against supreme court which today forced them to take an ultimate action, rightly so...

The winner in all this is the army as it weakens the government at a time when judiciary itself is shaking due to the CJ's son scandal. In a democracy, the only entities who bring a change in the regime should be the janta or their elected representatives. In extreme cases, the president can intervene but what is the judiciary doing disqualifying a sitting PM? This is the wording of the article 63 under which the court threw out Gilani Is there no other member of parliament who has been convicted by the Supreme court before? If there are, how can Gilani alone be disqualified? The wording of the article itself is very vague and leaves it upto the court to decide who it wants to disqualify.

This will lead to instability and we might end up with the dreaded military rule. This govt had few months before the fresh elections so all this drama was not needed.

Yeah its not just the "sign" :) it actually is an independent judiciary, and army is not any winner because army has nothing to do with all this, rather for the first time even army played extremely positive role, never tried to found any opportunity . Also SC took whole action through proper channel so no damage is done to parliament as an institute or democratic system. Supreme Court simply i. asked election commission to disqualify PM as member National Assembly ii. asked President to invite parliament to choose new Prime Minister and let the system continue. Also its just common-sense, there is one law that no convicted person can hold any public office, PM was convicted 2 months ago, SC gave him symbolic sentence of 30 sec assuming he will resign right after that which he didnt, neither he went for any appeal which automatically means he accepts himself as convict and after this even an ordinary citizen can file a case in SC for PM removal... Rest of your questions like why PM alone and how judiciary can do this can b answered if you plz urslef explore last 5 years history and relevant events. This all will make sense if you go through tep-by-step and check what was NRO the most shameful law, its beneficiaries then nullification by SC, president and PM's negative role, how and why the case started, how proceeded, starting decisions and how parliament (in this case PM alone) violated rule of law rather made fun of judiciary, conviction and events after that and apparently why SC took this ultimate action.

Bro, completely disagree with you :) i. Judiciary was rather started to publically questioned that why they are continuously showing this leniency in Gilani case. SC just tried their best to give PM as many chances as possible; you know we all even made fun of that 30 sec sentence. This action was due rather long time ago and even PPP know this very well, they were all set and mentally prepared to face this. ii. Army is absolutely not interested to derail democracy. You know if it was 90s, army would have intervened 10 times in current PPP regime alone but now this also a v good news for Pakistan that may be for the first time in history army honestly want this system to continue and they are simply not goin to takeover anymore.

Asim Posted June 21, 2012 Author Posted June 21, 2012 Although this was an ideal time to call new elections but PPP bringing in new PM: Makhdoom Shahabuddin, one of potential candidates... Now whats going to happen is: Ironically, He (or whoever for that matter will become PM) will take charge under Zardrari instructions to follow exactly same Gilani lines against Supreme Court and he will come knowing the fact that he can straight away face contempt charges and then disqualification within 1-2 months :) that would create some crisis and anything can happen then but most probably National Assembly will be dissolved, Care-taker setup will be brought-in and new elections will be called
