Official statement from Attorney's Office http://www.justice.gov/usao/nys/pressreleases/December13/KhobragadeArrestPR.php In case Khobragade did as the US DA suggests, she is dead meat! The first contract says that she will pay an hourly salary of 9.75USD but if she signed another contract for 30,000 per month or 3.31USD per hour - she will be done in a court of law. IIRC, January 14 is the first hearing and it will be interesting how this pans out.
DA is toast.It has sparked a standoff between US and another nuclear armed nation.India is not a banana republic and its already been made clear by sources to media that India is talking at very high levels in US and little attention is being paid to some lowly DA or a spokesperson. Is the DAs office conducting a prosecution in the media or in the court ? What is the purpose of releasing this info which at this stage is a matter of he says she says ?

Will the Manmohan Singh govt grow enough balls to arrest a US consulate staff in retaliation ? If UPA does not respond, BJP should make it an election issue citing the pusillanimity of the govt. Will also fit nicely into the fact that Modi has withstood a US visa ban etc.

Lol.Kabhi Kabhar Indian news channels dekh lo.If she gets immunity now the case will continue but because she now has immunity they cant arrest her nor can they force her to come to court.The old case may continue and she may be found guilty but she cant be touched. Secondly how long will it for her to get a passport from her embassy. If US refuses her accredition in UN then all hell will break loose as not even Iranians or Cubans can have been denied such immunity when going to UN. But UN is run by US. So UN is not going to affor her the immunity atleast for now. Point 1: India will not be able to get her out of US without the consent of US. Point 2: What India has now made is only a knee jerking reaction and the government very well know they can't do anything other than it. Even if she is sentenced for 10 years, India can't and won't be able to imprison an American for even a single day. Point 3: Only a few wrist slitters among the very few who watch our national media want the bhabhi to be released. The rest are not even ready to give a damn about this arrest. Point 4: If people are really pissed with this bhabhi's arrest, India should have gone on war with US when they searched Dr. Abdul Kalam in the airport.

The holier-than-thou attitude in Bharara's speech is nauseating. US has made sure its diplomats get away with murder and hit and run which happened in broad daylight, without as much as a slap on the wrist. Acting as if the United States is a moral guardian of the world does not compute

That's how the embassy is arguing that since she isn't paid in US standards like her she can't pay the maid and the US knows about it. But the problem is - she wrote in the visa application she will pay 4500 per month to the maid but ended up paying less. The counter argument to that is that the maid is being compensated via other means like lodging, food etc. which makes up for the difference in fees. The core issue now is will that hold up in the SDNY court.

The core issue now is will that hold up in the SDNY court.[/quote'] "Not paid in US standards" is WAY different than "Not paid minimum US wage". Again, no way she is paid less than minimum wage. NO ****ING WAY. Proof please. US standards would mean something like $150K a year for a diplomat like her. Minimum US wage is approx $20K a year.

Another day goes by without any meaningful response by the UPA apart from statements. The only way to send US a message would be to arrest a female US consular officer and subject her to custodial rape like Ms Khobragade has been.
Tit for tat? That would be a definite gamble in this situation. Outside India, there is no country nor people who has and will support India on it as US has presented this well on minimum wages.

But India needs to address the maid situation first and get DK out of the mess, out of court settlement, give her the money to withdraw the case. And then withdraw all niceties extended to US personnel in India, no freebies, no special passes, no VIP treatment. Cancel all official entry documents PIO/OCI of the DA's family.
