Soumitra Bose | Last updated on Friday, 16 May 2014 16:10 In spite of opposition from the Board of Control for cricket in India, the Supreme Court has asked Justice Mukul Mudgal to carry on the probe into the Indian Premier League spot-fixing and betting controversy that rocked Indian cricket last year. The two-judge Bench ordered on Friday that a report must be submitted by the new panel in a sealed envelope by August-end. Appointed in October last year, Justice Mudgal had headed a three-man committee -- additional solicitor general L Nageswara Rao and senior advocate Nilay Dutta were the others -- that investigated the IPL scam. It had submitted two reports and a sealed envelope to the Supreme Court on February 10. Rao and Dutta will also be part of the new panel. The Supreme Court said a group of investigators headed by senior IPS officer BB Mishra will assist the Mudgal Committee. The fresh panel will have all the powers to probe, search and seize relevant documents and record evidence. The committee will have all the powers except the power to arrest. One former cricketer "of repute and integrity" will be chosen by Mudgal and Mishra. The focus of the second round of probe will be on the 13 names mentioned in the sealed envelope. Suspended BCCI president N. Srinivasan is one of the 13 names. It has been alleged that several top players, including India skipper Mahendra Singh Dhoni, have links with bookies. The sealed envelope contains incriminating but unverified information, according to the panel. Explaining why he turned down BCCI's request for a fresh panel sans Mudgal, Justice AK Patnaik, the senior judge on the Bench, said it was good for the reputation of the 13 persons in the sealed involved that their names don't reach "new eyes". Justice Patnaik said if the names became public, the reputations of "very famous" people "will be damaged beyond repair". The court said Sunil Gavaskar and Shivlal Yadav will continue as interim presidents till further orders were made. The former Test players were made stop-gap presidents after Srinivasan was stood down as BCCI head till investigations were over. Srinivasan's son-in-law Gurunath Meiyappan is facing corruption charges and has been indicted in Justice Mudgal's February 10 report. Gurunath was also a Chennai Super Kings team official.

The Cricket Association of Bihar filed PIL No.55 of 2013 in the Bombay High Court challenging the constitution of a panel of two retired judges of the Madras High Court by the BCCI to probe into the allegations of betting and spot-fixing in IPL, 2013 against Mr. Gurunath Meiyappan as the alleged Team Principal of Chennai Super Kings and the part-time owner of IPL Franchise Rajasthan Royals contending that the panel was not constituted in accordance with the Operational Rules applicable to IPL. The Cricket Association of Bihar accordingly made a prayer in the PIL that the BCCI be directed to recall its order constituting the probe panel and by the impugned judgment dated 30.07.2013, the High Court held that the constitution of the probe panel was not in accordance with the Operational Rules applicable to the IPL. The High Court, however, declined to constitute a fresh panel to inquire into the aforesaid allegations and took the view in the impugned judgment that the constitution of the probe panel was the prerogative of the BCCI under the Operational Rules applicable to the IPL. 2. Aggrieved by the impugned judgment of the Bombay High Court insofar as the High Court declined to constitute a fresh panel, the Cricket Association of Bihar has filed SLP © No.26633 of 2013 (now Civil Appeal No.4236 of 2014). Aggrieved by the impugned judgment of the High Court insofar as it held that the constitution of the probe panel by the BCCI was not in accordance with the Operational Rules applicable to the IPL, BCCI has filed SLP © No.25027 of 2013 (now Civil Appeal No.4235 of 2014). Both the special leave petitions were heard and on 08.10.2013, this Court passed an order constituting a Probe Committee comprising (i) Mr. Justice Mukul Mudgal, retired Chief Justice of Punjab & Haryana High Court, as Chairman, (ii) Mr. L. Nageshwar Rao, Senior Advocate and Additional Solicitor General, as Member and (iii) Mr. Nilay Dutta, Senior Advocate, Gauhati High Court, as Member. By the said order dated 08.10.2013, this Court directed that the Probe Committee will inquire only into (a) the allegations of betting and spot-fixing in the IPL matches against Mr. Gurunath Meiyappan, allegedly the Team Principal of Chennai Super Kings and the players and the allegations against the team owner of the IPL Franchise Rajasthan Royals and (b) the allegations against Mr. Gurunath Meiyappan and the team owner of the IPL Franchise Rajasthan Royals with regard to their involvement in spot- fixing and betting. 3. Pursuant to the order dated 08.10.2013, the Probe Committee (hereinafter referred to as the Justice Mudgal Committee) inquired into the allegations and submitted two reports. In one report, the Justice Mudgal Committee concluded that the role of Mr. Gurunath Meiyappan in Chennai Super Kings as the team owner as well as the allegations of betting and passing on information against him stands proved but the allegations of spot-fixing requires further investigation. The Justice Mudgal Committee also observed that the allegations of betting and spot-fixing against Shri Raj Kundra, team owner of Jaipur Cricket Private Limited (Rajasthan Royals), need to be further investigated. Copies of this report were furnished to all the parties. In the other report, the Justice Mudgal Committee referred to allegations against 13 persons including Mr. N. Srinivasan, the President of the BCCI, which came to the notice of the Committee during the probe but the Committee made it clear that they were only allegations and were not established and, therefore, the report was being submitted in sealed cover so as not to sully the reputation of any innocent person. According to the Justice Mudgal Committee, these allegations in the report submitted in sealed cover require verification and investigation. 4. We have looked into the allegations against the 13 persons including Mr. N. Srinivasan in the report submitted in sealed cover and we find that the allegations have relevance to the subject-matter of PIL No.55 of 2013 and require to be verified and investigated before the civil appeals arising out of the impugned judgment of the High Court are finally heard and disposed of. Accordingly, on 29.04.2014, we took the view that until a duly constituted Probe Committee investigates into the allegations made against the 13 persons including Mr. N. Srinivasan as mentioned in the report and until the Probe Committee submits a report, this Court cannot come to the findings necessary to finally decide these civil appeals. On 29.04.2014, we also heard learned counsel for the parties on what should the proper composition of the Probe Committee which should undertake the investigation into the allegations against the 13 persons including Mr. N. Srinivasan. Learned counsel appearing for the BCCI and Mr. N. Srinivasan submitted that the BCCI has constituted a Probe Committee comprising Mr. Justice J.N. Patel, former Chief Justice of Calcutta High Court, Mr. R.K. Raghvan, former Director of the CBI, and Mr. Ravi Shastri, former player and captain of the Indian cricket team. On request by this Court, Mr. Gopal Subramanium, learned Senior counsel appearing for the Justice Mudgal Committee, sought instructions from the Justice Mudgal Committee and submitted that the Justice Mudgal Committee is willing to undertake the investigation. He submitted a written note of the persons who can be appointed to assist the Justice Mudgal Committee in the investigation and the manner in which the investigation is to be done. On 29.04.2014, we reserved the matters for orders on the composition of the Probe Committee for investigation into the allegations against the 13 persons including Mr. N. Srinivasan in the report kept in the sealed cover and other incidental matters. 5. We are of the considered opinion that the allegations against the 13 persons including Mr. N. Srinivasan mentioned in the report submitted in the sealed cover should be investigated into by the Justice Mudgal Committee and the team of investigators because if a new Probe Committee is entrusted to inquire into the allegations, there is likelihood of the allegations being leaked to the public and such leakage will damage the reputation of the 13 persons beyond repair. 6. In the written note submitted by Mr. Gopal Subramanium appearing for the Justice Mudgal Committee, it is suggested that the Justice Mudgal Committee be assisted in the investigation by the following persons: (i) Shri M.L. Sharma, IPS (Retired); (ii) An officer from Mumbai Police (preferably not below the rank of Assistant Commissioner of Police); (iii) An officer from Chennai Police (preferably not below the rank of Assistant Commissioner of Police); (iv) An officer from Delhi Police (preferably not below the rank of Assistant Commissioner of Police); and (v) A former cricketer of repute and integrity. In view of objections made on behalf of the BCCI and Mr. N. Srinivasan, we are of the view that instead of Shri M.L. Sharma, IPS (Retired), Shri B.B. Mishra, IPS of the 1983 batch of Assam-Meghalaya Cadre who has a vast experience in investigation including experience in the CBI and who is presently working as Deputy Director General, Narcotics Control Bureau, New Delhi, should head the investigation team. The other officers from Mumbai Police, Chennai Police and Delhi Police and a former cricketer of repute and integrity mentioned against serial Nos. (ii) to (iv) above will be chosen by the Justice Mudgal Committee in consultation with Shri B.B. Mishra. 7. We further direct that the competent authority of Government of India will pass appropriate orders placing the services of Shri B.B. Mishra at the disposal of the Justice Mudgal Committee till completion of the investigation and submission of the report to this Court. Shri B.B. Mishra and the other officers of the investigating team will have the powers to investigate, require attendance of witnesses, the power to examine witnesses, the power to search and the power to seize and all other powers necessary for investigation except the power to arrest and the source of these powers of investigation will be this order passed by this Court. All concerned persons including the BCCI, Mr. N. Srinivasan and the cricket players will co-operate with the investigation in all respects. In case of any difficulty, the Justice Mudgal Committee may apply to this Court for necessary orders for the purpose of completing the investigation. After investigation, the report will be filed in this Court by the Justice Mudgal Committee by the end of August, 2014 in a sealed cover and the Members of the Committee and the investigation team will not reveal anything regarding the investigation to others and the media and will maintain absolute confidentiality. 8. As directed in our earlier order dated 08.10.2013, the BCCI will bear all the expenses of travel, boarding and lodging of the Chairman and Members of the Justice Mudgal Committee as well as Shri B.B. Mishra and other officers of the investigation team. The Chairman and Members of the Committee will also be entitled to fees of Rupees One lakh per working day from the BCCI. The Central Government as well as the concerned State Governments will continue to pay the salary and other allowances to be paid to Shri B.B. Mishra and to all other officers of the team of investigation and the BCCI will reimburse the appropriate Government accordingly. The cricketer who is included in the team of investigation will also be entitled to fees of Rupees One lakh per working day from the BCCI apart from expenses of travel, boarding and lodging. 9. The matters will be listed in first week of September, 2014 for further hearing before the appropriate Bench. In the meanwhile, Mr. Sunil Gavaskar and Mr. Shivlal Yadav will continue to exercise the powers of the President of the BCCI as per the order dated 28.03.2014 of this Court. (A. K. SC declines Srinivasan's reinstatement appeal,AGAIN

The Supreme Court has declined N Srinivasan's plea to be reinstated as the BCCI president for non-IPL affairs. The court has ruled it will not interfere with an earlier order that had asked Srinivasan to stand aside as board chief for the duration of the investigation into alleged corruption in the IPL.* Justice Balbir Singh Chauhan, who heard the matter, asked Srinivasan's lawyer to appeal to the same bench that had passed the earlier order. Srinivasan had also filed an affidavit of urgency stating that by the time the court sits next on this matter as scheduled, in September, his term as president of the BCCI will have come to an end and "no purpose would, therefore, be served even if the aforesaid restriction is removed". The appeal refers to the sealed envelope submitted to the court by the Justice Mudgal Committee, which includes names of persons who need further investigation, and states that none of the other 12 persons named there have been restricted from functioning in the IPL. "It is only the applicant [srinivasan] who is having to face the stigma of restriction from functioning as the president of the BCCI" despite no charges having been established, the petition said. The appeal also stated that the order to restrain Srinivasan from functioning as the BCCI president was passed "without taking into consideration that there is no material whatsoever on the record to substantiate the allegations of betting and/or spot-fixing against the applicant or even of non-cooperation with the probe panel" constituted by the court. It called the order "inessential", and pointed out that the court had itself refused to form an opinion against Srinivasan. Contending that his "unceremonious exclusion" from discharging even the remaining non-IPL 2014 related functions was "too drastic a step and extremely harsh," Srinivasan, however, said he had no objection to Gavaskar's appointment and continuation to function as the BCCI president for IPL 2014. The court's view so far, though, has been that a fair probe into the charges against Srinivasan and others would not be possible while Srinivasan was the board president. Before passing its first order on March 26, Justice AK Patnaik had told BCCI's counsel: "Though there is no definite finding in the report in the sealed cover, the allegations are so serious they require further investigation, which the BCCI can't do on its own and it has to be done by an outside agency. That's why we are saying that Mr. Srinivasan must step down for a fair probe." The appeal also referred to the potential for "adverse impact on the career prospects of the applicant in future" if the order was not modified. Srinivasan is set to become the ICC president in July, but the petitioner in this case, Aditya Verma of the unrecognised Cricket Association of Bihar (CAB), has been pleading that a man who has been asked to stay away from BCCI affairs should not be allowed to represent the body at the ICC. The court has not, however, expressed its views on this issue. It is understood after the last order was read out on May 16, BCCI's counsel approached the bench, seeking permission for Srinivasan to attend ICC meetings and BCCI's next AGM, but the court said no further order was going to be passed. This is the second time in the last two months that Srinivasan has sought a similar relief. In an affidavit filed on April 15, he had said he was "highly aggrieved by the unfair and unsubstantiated allegations" filed by the CAB against him. Turning down his appeal, the court for the first time revealed contents of the sealed enveloped saying Srinivasan's was the 13th name among "very important personalities in cricket", and that there were 12 allegations against him. Justice Patnaik was blunt in pulling up Srinivasan when he said, "It seems that Mr Srinivasan has not taken the allegations seriously." The case dates back to June 2013, when Verma raised charges of a conflict of interest in the BCCI's original two-member inquiry panel for the IPL corruption issue. A Bombay High Court ruling later termed the probe panel "illegal". The BCCI and the CAB filed petitions in the Supreme Court against this order, with the CAB contending that the Bombay High Court could have suggested a fresh mechanism to look into the corruption allegations. The Supreme Court then appointed a three-member committee, headed by former High Court judge Mukul Mudgal and comprising additional solicitor general L Nageswara Rao and Nilay Dutta to conduct an independent inquiry into the allegations of corruption against Srinivasan's son-in-law Gurunath Meiyappan, India Cements, and Rajasthan Royals team owner Jaipur IPL Cricket Private Ltd, as well as with the larger mandate of allegations around betting and spot-fixing in IPL matches and the involvement of players.

Court has suspended Srini from BCCI until the probe report to be submitted in September. This effectively means Srini lacks power for about 6 months since he was suspended by SC. The fixing statements involving Lou Vincent too have been somehow leaked to the media without his knowing. He is no more a powerful person in cricket, rather someone who is struggling as a cricket administrator. No wonder that Srini is clutching at straws now. Supreme Court is not a CSK cricketer which can be dictated what to do on and off the field. It's good that Supreme Court is getting involved in Indian cricket and dictating the terms which imo was crucial given the way BCCI have administered Indian cricket. Not long before BCCI had a stance that it is an independent body and should not be bought under control of Indian sports ministry. The dilution of power was necessary given the rampant corruption as well as severe wrongdoings have been proved in court recently.
