Boy, 13, who raped woman is jailed for just three years... because he said 'sorry'

Hmmm.....you guys seriously think this was a lenient sentence? What do you want - to imprison a 13 year old for 20 years in an adult prison - might as well kill him instead. What he did was horrific, but there are reasons for it. The kid is not normal and should be given a chance to regain a semblance of life and mental balance. He would likely be monitored by psychologists anyways, and I am not sure what the success rate is of reformed kids in situations akin to those but certainly feeding a 13 year old for whatever crime into an adult penitentiary for a decade certainly cannot be the best alternative.
There is a bit of similarity in our point of views-
And we think law only goes soft on girls! Having said that, the guy is only 13 years old and guys at that age can get a bit carried away. As long as he was sincere with his "sorry" (which seems to be the case as he got 3 yrs) and repents, its fine. 3 yrs is not less. The guy will be spending his puberty in jail and his name has been sprayed over the internet. This is going to haunt him for quite a while.

I believe the sentences should be as horrific as the crimes, it should scare people away from committing such crimes. May not be the best idea, as prison is supposed to be some form of rehabilitation, but lets take a look at the numbers in prison, I don't think that is working, maybe a new approach is needed

God help the society if we're going to treat a 13 year old juvenile the exact same way as a 45 year old serial sex offender. Theres are precise and quite justifiable reasons (borne out of moral, psychological, evolutionary and a multitude of other factors) why the laws are different for these two groups of people. If we were treat everyone the exact same way based purely on the nature of crime, then it will be following a justice deliverance system generally adopted by lunatic fanatics like the Taliban, who routinely beheaded young boys to old men, on suspicion of 'spying' and 'treason'.

Sorry sriram, as much as I respect your views this analogy is completely irrelevant to this situation. If you have a 13 year old committing a robbery or having shot someone by mistake (using the gun at home erroneously etc) and he is treated as a juvenile I can fully understand that. Everyone needs a chance to reform. However, a 13 year old lad dragging a youg woman, brutally assaulting and beating her prior to raping her is a very heinous crime. A crime which shows that the young lad is not a child mentally but rather an adult. A person is treated as a juvenile in a legal case mainly due to his inability to judge the difference between right and wrong. But can you honestly tell me that in this case he was not able to judge that what he was doing is wrong? The boy should have been punished with a longer prison term just like he would have been had he been tried by a US court.

The sophistication of a legal system can be determined in way which it is able to make minute, yet significant distinctions in the nature of crime that was committed and the person who committed the crime. As I said, there are quite expansive and completely justifiable reasons why the legal system distinguishes between say a an adult sex offender and a 12 year old juvenile. If you're going to completely ignore them and focus merely on the severity of the crime being committed, you're missing the point by a mile. Rather, if we were adopt the 'Single-brush-for-all-paintings' approach that you have suggested, it would mean reversing, decades, if not centuries worth of evolution of our moral conscience and legal framework.

I already replied to you that my intention is clearly not to try every juvenile offender as an adult. But a sex offence at the age of 13 forgive me for my disbelief cannot arise out of some juvenile misguided belief system. This crime has not been committed without knowledge of difference between right and wrong. The law would not be any less sophisticated if this kind of serious offences by youngsters are tried in an adult court. In relation to the nature of this crime what exactly is your argument for trying him as a juvenile? You accuse me of painting everything with a broad stroke of the brush but based on your response you seem to be guitly of the same. Your assumption is based on the belief that I recommend all youngsters to be tried in an adult court which is clearly not the case.

That's exactly the reason why relatives of the person involved are not allowed to have a say in the justice meted out to the criminal - to maintain objectivity. What you are purporting is the Taliban style of justice where the relatives of the victim can even pardon the person in exchange for money.

You would do well to remember that retribution, revenge, and punishment should not form the cornerstones of a civilized judicial system - reform must. The idea of imprisoning a 13 years old with hardened adult criminals for a decade leaves no chance for reform.

This is a weird case, at 13 if he knows how to rape a woman, then he needs to be in a psychiatric facility and not in a jail. He can be a menace to society if he is jailed and returned back to society without any counseling he will do even worse things at 16/17. Rape has got very little to do with sex, more about the relishing the power they experience over a woman.

Digg can be ridiculous at times. To the digg users, anything against US is an insult to their self-respect while they go about writing crap about pretty much every other country apart from theirs. Hypocrites. Having said that, I believe the Goa govt. needs a kick in the nuts. But I partially agree to the fact that adult foreigners need to dress with a bit more modesty. Every country has its rules. Ask these rule-breaking fundies to try challenging the law in Europe or America and they shall know.
