ViruRulez Posted March 27, 2012 Posted March 27, 2012 NEW DELHI: Wilful denial of sex, including that on the first night after wedding, by either of the spouse amounts to cruelty and can be a ground for dissolution of the marriage, the Delhi high court has ruled. Justice Kailash Gambhir gave the verdict, upholding the lower court's decree of divorce to a man having a "sex-starved marriage" as his wife refused to have sexual intercourse with him on the wedding night and making him long for it for the subsequent five months, left her matrimonial home. "In the present case, the testimony of the husband that the wife was never responsive and was like a dead wood when he had sexual intercourse with her remained unrebutted. "It is not that the husband had sex with his wife only about 10-15 times from the date of his marriage within a period of five months, but the wife's cruel act of denying sex to the husband especially on the very first night and then not to actively participate in it even for the said limited period for which no contrary suggestion was given by the wife," the court said. It cited various Supreme Court judgements on the issue and said "it is evident that wilful denial of sexual intercourse without reasonable cause would amount to cruelty." Referring to the apex court's observation that "sex is the foundation of marriage and marriage without sex is an anathema," Justice Gambhir said, "Marriage without sex will be an insipid relation." http://timesofindia.indiatimes.com/india/Denying-sex-to-spouse-on-first-night-ground-for-marriage-annulment-Delhi-high-court/articleshow/12394748.cms People already seem to be beetching about Indian morality in the comments section of that article. LOL. Discuss. :giggle:
ravishingravi Posted March 27, 2012 Posted March 27, 2012 Man!! For such a primal act ( i.e sex ), the more you restrict it, taboo it, sanctify it, glorify it, the more you will complicate what should really be a very normal experience of live. It just is. There is nothing more to it.
beetle Posted March 27, 2012 Posted March 27, 2012 Indian men and their first night obsession.:girl_haha:.....bloody desperate virgin boys...:--D The statement about the first night was unwarranted .The rest was good.Wonder why the poor guy had to wait for so long to get a divorce. She had abandoned him after a few months. He should have applied for divorce on grounds of abandonment. Poor guy...what a waste of life. As for the woman...she obviously just wants the `thappa' of marriage without having to deal with marriage.Stupid woman...bechare ki jindagi barbaad kar di.
DomainK Posted March 27, 2012 Posted March 27, 2012 Denial of sex has long been a valid ground for divorce under Indian law. It constitutes mental cruelty. However, never before was a time fixed for sex by a court. Would the court like to appoint a paralegals as an independent witnesses to see to it that couples are indeed abiding by it? Indian men and their first night obsession.:girl_haha:.....bloody desperate virgin boys...:--D This is seriously retarded given that most people are dead tired on first night - especially the brides. Wearing those heavy bridal costumes all day long can be tiring in itself, add to that all the customs, the crowds etc. IMO for the couples who have never done it before together, first night should not be the night of consummation.

DK, even 'denial of sex' is a very contentious issue. It pits the man's word against the woman's. Hypothetical scenario: The guy is some super despo who keeps asking his wife for sex every now and then. And she refuses most of the time. Can he still claim that he's being mentally tortured or subjected to cruelty? And who is actually being subjected to mental cruelty? The time period for considering ( its one factor) a divorce is non consummation in one year of the marriage.

First night not necessarily mean the first night immediately after wedding. Seen in countless movies that first night gets postponed to days or weeks.. so not always :finger:

The preceeding three are full of customs and stuff, ofn course it changes from state to state - it's unbelievable how different a Hidnu marriage can be in different places. But in most places it's he fourth night after marriage. Even the fourth night is not exactly a relaxing night for the bride or the groom.

I think it's usually left to the judge to decide whether it really contributes to cruelty or not.

Such issues are common causes of marital problems in any hierarchical society.
