Legally this is a case which involves a minor and law rightly differentiates between a minor and an adult. My comments are for general cases where both adults are involved.
I think any act with mutual consent should never be considered rape. All promises of marriage, job ,or whatever should be dealt under breach of promise or cheating. This would be fair to all.....and most importantly be fair to real rape victims.

I think that is very important aspect. These frivolous complaints take the severity away from complaints for real victim as law enforcement agencies start have suspicions about their stories as well.

It means that she has had been with him since he was 15-16' date=' IMO she should be in prison for having sex with a minor.[/quote'] Legally speaking, yes. But otherwise, 15-16 is old enough

Legally speaking' date=' yes. But otherwise, 15-16 is old enough[/quote'] old enough to be horny, but for everything else they are still kids. They can easily be influenced, misled and exploited by an older authority figure. Why else is it considered wrong and foolish for people to get married at that age?

No. There is a reason 16 year old person is considered a minor.
Can't agree. I was ready at 16(i believe). people of 16 yrs look old enough to me. kids start seeing porn probably by 13 these days

I bet you were more likely to make a bad decision and were more easily convinced when you were 16. Its not that knowing about sex is enough, also not all people are as mature as you were.

Mentally they are not old enough to realize how their entire life may be affected by their impulsive actions, like how this 16 year old kid is now stuck with a baby and a woman crazy enough to want to marry him. A 10th passout kid is not mature enough to make such life decisions and anyone influencing him to make such decisions should be punished.

In this case, it's the adult girl's fault. If one starts seeing porn from 13 on his pc/phone, he still gets 3 yrs to get mentally mature before having sex 16. I am not inclined to keep him waiting for 5 yrs from 13

There is a difference between knowing about sex and long term consequences of decisions taken at the age of 16.

we got to gradually remove the societal consequences. Other consequences aren't unmanageable. And we aren't talking abt just knowing, we are talking abt masturbating from age 13 to 16

Dont know much about law' date=' neither I care about what law is applied in this case. It is commonsense here that man gave a false assurance to have sex with her , beget a child and now running away from taking responsibility of the child. Of course if rape law is not suitable to apply here, have some other law which hands out punishment to the man. [b']If you want to have sex, dont give false assurances.
So you're sayin women are just wodden logs who don't want to have sex?

What made you to think so? There are women who are willing to have sex for enjoyment, and there are some who doesnt want to have sex without marriage. All I am saying is dont give false assurances of marriage to force a woman to have sex , and the cheat on her.

I have read that women don't even have to prove that man gave her assurance of marriage, just her word is enough. is that correct?

Where have you read that?
"When a grown up, educated and office-going woman subjects herself to sexual intercourse with a friend or colleague on the latter's promise that he would marry her, she does so at her own peril. She must be taken to understand the consequences of her act and must know that there is no guarantee that the boy would fulfil his promise.
