Crookbond Posted December 8, 2014 Posted December 8, 2014 I had a look into Uber's Legal T&C and here's the most interesting part. Check Section 2 UBER DOES NOT GUARANTEE THE SUITABILITY, SAFETY OR ABILITY OF THIRD PARTY PROVIDERS. IT IS SOLELY YOUR RESPONSIBILITY TO DETERMINE IF A THIRD PARTY PROVIDER WILL MEET YOUR NEEDS AND EXPECTATIONS. UBER WILL NOT PARTICIPATE IN DISPUTES BETWEEN YOU AND A THIRD PARTY PROVIDER. BY USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU MAY BE EXPOSED TO SITUATIONS INVOLVING THIRD PARTY PROVIDERS THAT ARE POTENTIALLY UNSAFE, OFFENSIVE, HARMFUL TO MINORS, OR OTHERWISE OBJECTIONABLE, AND THAT USE OF THIRD PARTY PROVIDERS ARRANGED OR SCHEDULED USING THE SERVICES IS AT YOUR OWN RISK AND JUDGMENT. UBER SHALL NOT HAVE ANY LIABILITY ARISING FROM OR IN ANY WAY RELATED TO YOUR TRANSACTIONS OR RELATIONSHIP WITH THIRD PARTY PROVIDERS. https://www.uber.com/legal/usa/terms
Old guy Posted December 8, 2014 Posted December 8, 2014 This company should be banned People should search about amount of bs they have got away with ..
Crookbond Posted December 8, 2014 Posted December 8, 2014 Ok' date=' but IMO Uber is being made scapegoat. Forget about any cab driver, let see if you want to do a background check of the guys who are member of ICF, how would you do that? Is there any system in place in India to do a background check other than ofcourse the police verification which costs a mere Rs 2000/- in NCR and police officer without even seeing the face of person will give police verification certificate. Is there any system where I can provide the Driving License or PAN number of a person and will be able to get his past criminal records?[/quote'] You are mixing up two points - (1) Should a verification be done? and (2) How effective is the verification? You can argue all that you want about (2) but it is inexcusable that (1) hasn't been done. I am quite sure there is a system to verify criminal records. I have written to the Addl Superintendent Police of a Special Task Force to confirm this. Once I know more, I will post the details here.
Crookbond Posted December 8, 2014 Posted December 8, 2014 Uber Banned. :WTF: Now lets ban BJP and Congress too for Maderana and Nihal Chand. Uber has been banned for less non-serious stuff across a few countries in the world.
FischerTal Posted December 8, 2014 Posted December 8, 2014 forget taxi service, i wouldn't trust anybody in india unless you have close family connections. for example, even when it comes to doctors, my family in india only goes to those doctors who were my father's batch mates in medical school. too many clinics propping up these days where the doctors are either unqualified or have close connections with pharma companies in which they recommend drugs of the companies they are doing business with

I totally agree but try to understand there have been many instances were Auto Drivers have misbehaved, one of my friend who was heavily drunk last year was robbed by Auto Driver and beaten up also. No body took any action against the RTO or the transport department responsible for Auto Driver Licensing. There is no meaning of Point 1 if Point 2 is not effective.
hhunaeh Posted December 8, 2014 Posted December 8, 2014 Delhi Government bans Uber, says it is misleading customers Mathur pointed out that cabs ferrying customers in Delhi from point-to-point have to follow rules under the Radio Taxi Scheme, 2006 which specifies that the licensee must be either a company under the Companies Act, 1956 or a society under the Societies Registration Act, 1860. The rules also say that licensee must demonstrate possession of adequate parking space for all taxies and office space (minimum of 1000 sq. ft.) for accommodating the control room with radio communication and ten telephone lines, minimum fleet size per license would be 500 motor cabs and vehicle must be fitted with GPS/GPRS based tracking devises which must be in constant communication with the Central Control unit while the vehicles is on duty. "The rules also say that the radio taxi licensee shall be responsible for quality of drivers, their police verification, employer control and supervision of drivers, employee behaviour. The employers shall also ensure that the drivers are totally safe, reliable and trustworthy. But Uber never applied for any permission to us, is not recognised under the Radio Taxi Rules and has flouted most of the laid-down rules," Mathur said. He however denied receiving any complaints against Uber in the past. Uber doesn't do all of this because they are just an app on a mobile which logs data into servers in ny. How many people do they have in their delhi office, which was so difficult to locate and what do the employees do? People should be educated on the differences between radio taxi services and services like uber. Most of us don't know the difference. I didn't too till yesterday.
G_B_ Posted December 8, 2014 Posted December 8, 2014 just a question I used Meru cabs when i was in India. Do they vet their drivers?
Stuge Posted December 8, 2014 Author Posted December 8, 2014 Remember date is not mentioned when it was given. In May 2014, Addl Dy Commissioner of Delhi certified that rape accused Shiv Kumar Yadav had no criminal record pic.twitter.com/cfOgOXXNhf— TIMES NOW (@TimesNow) December 8, 2014

Tiger80 Posted December 8, 2014 Posted December 8, 2014 Revealed: Accused driver given clean chit by police Previous FIR with TIMES NOW has revealed how the accused of the Delhi cab rape case is a repeat offender. He was given clean chit by Delhi Police in May, 2014. Driver's character certificate was given by additional deputy commissioner of police. http://www.timesnow.tv/videoshow/4470569.cms
asterix Posted December 8, 2014 Posted December 8, 2014 If UBER had not been taking payments on behalf of the third party service providers, I can agree with the argument that "it's just an APP". Once you start taking payments on behalf of your third party service providers, it mandatory to provide at least basic level of customer protection... Like what Amazon does regarding Amazon Market Place...

Crookbond Posted December 8, 2014 Posted December 8, 2014 Legally, here is what Uber should do. The question is why were they pulled AFTER something happened? Typical reactive glorious Indian mentality. http://delhi.gov.in/DoIT/DoIT_Transport/trrs31.pdf
Raghav_12 Posted December 8, 2014 Posted December 8, 2014 Yup. It would have made sense to protest before the rapist was caught. It seems police did a good job in this case. So what exactly is the demand of AAP snd NSUI. I might be missing something. Why there were protests in case 2 years ago. There too culprits were caught. Did you raise this question then too. Internal security lies with Home Minister. Period. Even if culprits were caught, it doesn't change the fact that incident happened. There were similar protests against Sheila Dixit as well. Did you question that time that what Shiela Dixit got to do with that ? Seriously.
Raghav_12 Posted December 8, 2014 Posted December 8, 2014 Uber Banned. :WTF: Now lets ban BJP and Congress too for Maderana and Nihal Chand. Stupidity. and BAN police as well for failing to secure safe environment.
beetle Posted December 8, 2014 Posted December 8, 2014 When a person hires these kind of Taxi services ...that person expects enough safety mechanisms that the ride will be safe. No one can vouch for anyones true character at all times...but they have to ensure no crime can happen in the taxi ride without fear of being caught immediately. The fact that a person with a previous record has been kept is unforgivable.Whether it was the lack of verification or false verification...heads need to roll. You can't promise a safe ride and not deliver.Period.
Raghav_12 Posted December 8, 2014 Posted December 8, 2014 People should understand that Uber is just aggregator and distributor for demand and supply. They are not actually service provider. Service providers are eventually cab drivers. If driver had some criminal record, his driving license should have been revoked by administrative authorities or any other similar measure. Holding Uber responsible so much that they be banned doesn't make sense.
Khalpat Posted December 8, 2014 Posted December 8, 2014 Why there were protests in case 2 years ago. Seriously. Did you supported the protest against Sheila at that time? If no then why are you supporting it now. Two wrongs do not make right. Is this philosophy only for preaching purpose? Anyways you won't answer it so let me not waste my time. I just saw cliping on one of the news channel in which people were protesting at the residence of Rajnath and the news reader was not telling as to what exactly was their demand, I just asked a question about the reason of the protest to which DM answered after that we discussed about reforms which are needed and technical difficulties in implementing. Whenever their will be such incidents, public is going to react. Government is elected to manage and administer. Sheila and her team along with Manmohan totally failed in managing this and also the gruesome and brutality of that incident which happened two years back was such that any city of any country would have reacted in the same way. If Rajnath and his team also goes on the same path, kick them out he is not my chacha that I am going to defend him but I can ask questions. Because it doesn't seem like public outrage it was more of politicizing the issue which did not had any public support.
asterix Posted December 8, 2014 Posted December 8, 2014 ^ As the payment collector on behalf of the "service provider" UBER does has responsibilities including ensuring continuous tracking of the vehicle and alert system if the tracking is deliberately interfered with by the service provider. What mechanisms it has to alert the authorities in that case, etc.
