rkt.india Posted March 11, 2015 Posted March 11, 2015 Wait' date=' how can criminal cases be "dropped"? A criminal case is not just bought by the plaintiff but the state/union/people against the defendant. It can't be just "dropped". Can someone tell me what type of justice system Bangladesh follows?[/quote'] Case isnt dropped.

Can someone tell me what type of justice system Bangladesh follows?[/quote'] In India (and I believe in most of the countries, charges are divided in two categories, one is compoundable and non-coumpoundable. Compoudables charges can be withdrawn by the person who brought those charges while non-coumpoundable ones can not be. In India rape would fall in category of non-compoundable so can not be withdrawn by the person filed the case. But this categorization is just for technical purposes. In reality if a rape victim doesn't want to pursue the case, it would any way fall. Just that it would take a little longer and little more of running. On the other hand, doesn't this whole thing seem to be rather insenstive joke around word rape? It is being treated if it is matter of joke. Just sham cases should be dealt rather strictly by prosecutors if they want to be fair to real victims.
Raghav_12 Posted March 11, 2015 Posted March 11, 2015 NO - now' date=' they are not.[/quote'] There is no amendment. As far as I know there was no change in IPC which still maintains that sex under promise of marriage would be rape. There is no fundamental change in that position. If I remember correctly, there has been just an advise from SC to treat these cases carefully as there were a large number of such cases are coming.

That kind of sets the precedent, IIRC. In fact, recently I just read that the SC has even made an observation that rape survivor's testimony is not the truth.

vvvslaxman Posted March 11, 2015 Posted March 11, 2015 Is it a "technical" rape? Not a forced one right?
